En el presente artículo se analizará los efectos nocivos del modelo de concesión en el
sector ferroviario peruano al intentar fomentar la competencia en un mercado aguas
abajo. El objetivo general es analizar y describir estos efectos negativos. Como hipótesis
se sugiere que el modelo de concesión ha tenido un impacto perjudicial, forzando una
competencia ineficiente en el mercado ferroviario. Para ello, es fundamental el estudio
de las características y marco normativo de la concesión en el Ferrocarril Sur Oriente
(FSO), mientras que los objetivos específicos buscan evaluar estos aspectos. Finalmente,
se concluye en que existen limitaciones en la competencia, inadecuación normativa y la
falta de conveniencia en el proceso competitivo del FSO.
En tal sentido, la primera parte, aborda el proceso de privatización en el contexto de
hiperinflación y crisis económica, centrándose en el sector ferroviario y específicamente
en la vía del FSO. Se exploran los modelos de concesión (separación vertical, integración
horizontal, y acceso competitivo) y se destaca la importancia de comprender el concepto
de mercado aguas abajo en el transporte ferroviario. La segunda parte se adentra en el
marco normativo aplicable a la promoción de inversión privada, buscando comprender
los objetivos detrás de la concesión y su relación con la competencia, examinando si se
priorizó mejorar el servicio o asegurar retribución al Estado. Finalmente, la tercera parte
evalúa la conveniencia del proceso competitivo en la concesión del FSO, considerando
el contexto económico, los factores de competencia y la adecuación de los criterios del
Contrato de Concesión, cuestionando si se realizaron estudios profundos sobre
eficiencia económica y conveniencia social, y explorando si se aplicaron criterios
adecuados o basados en experiencias extranjeras, que podrían haberse convertido en
factores perjudiciales. / This article will analyze the harmful effects of the concession model in the Peruvian
railway sector when trying to promote competition in a downstream market. The
general objective is to analyze and describe these negative effects. As a hypothesis, it is
suggested that the concession model has had a detrimental impact, forcing inefficient
competition in the railway market. To this end, the study of the characteristics and
regulatory framework of the concession in the Ferrocarril Sur Oriente (FSO) is essential,
while the specific objectives seek to evaluate these aspects. Finally, it is concluded that
there are limitations in competition, regulatory inadequacy and lack of convenience in
the FSO competitive process.
In this sense, the first part addresses the privatization process in the context of
hyperinflation and economic crisis, focusing on the railway sector and specifically on the
FSO route. Concession models (vertical separation, horizontal integration, and
competitive access) are explored and the importance of understanding the concept of
downstream market in rail transportation is highlighted. The second part delves into the
regulatory framework applicable to the promotion of private investment, seeking to
understand the objectives behind the concession and its relationship with competition,
examining whether improving the service or ensuring remuneration to the State was
prioritized. Finally, the third part evaluates the convenience of the competitive process
in the concession of the FSO, considering the economic context, competition factors
and the adequacy of the criteria of the Concession Contract, questioning whether indepth studies on economic efficiency and social convenience were carried out. and
exploring whether appropriate criteria were applied or based on foreign experiences,
which could have become detrimental factors. / Trabajo académico
