Enquanto a exposição midiática incita propostas visando a redução do marco inicial da responsabilidade penal, sob a justificativa de que os adolescentes infratores não são responsabilizados, a Constituição Federal e, mais especificadamente, o Estatuto da Criança e do Adolescente (ECA), buscam garantir outros caminhos como forma de responsabilização dos adolescentes quando da prática do ato infracional. É justamente em meio a este debate que se insere esta dissertação que apresenta como objeto de pesquisa a medida socioeducativa (MSE) de liberdade assistida (LA), uma política pública que busca a responsabilização dos adolescentes diante de atos infracionais, respeitando seus direitos e sua particular necessidade de atenção. A pesquisa buscou analisar a MSE de LA na perspectiva de investigar se durante o seu cumprimento é garantido ao adolescente autor de ato infracional a proteção de seus direitos fundamentais e sociais e, desta forma, verificar se tal medida pode ser considerada como instrumento de cidadania. Para a consecução dos fins pretendidos, a pesquisa foi dividida em duas partes principais: a primeira, de base teórica, correspondeu à prospecção de fontes bibliográficas sobre os direitos infanto-juvenis e cidadania; a segunda, de base empírica, e vinculada à primeira, consistiu na investigação do modelo de aplicação da MS... (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: The practice of infractions by adolescents is a problem that has generated great repercussion in the national scenario with very controversial views. While the media exposure prompts proposals aimed at reducing the initial frame of criminal responsibility, on the grounds that juvenile offenders are not held responsible, the Federal Constitution and, more specifically, the Child and Adolescent Statute (ECA), seek to guarantee others as a form of accountability of adolescents in the practice of the infraction. It is precisely in the midst of this debate that this dissertation is inserted that presents as object of research the socioeducative measure (MSE) of assisted freedom (LA), a public policy that seeks the accountability of adolescents in face of infractions, respecting their rights and their particular need for attention. The research sought to analyze the MSE of LA in order to investigate whether during its compliance the adolescent author of an infraction is guaranteed the protection of his fundamental and social rights and, in this way, to verify if such a measure can be considered as an instrument of citizenship. In order to achieve the intended ends, the research was divided into two main parts: the first, on a theoretical basis, corresponded to the prospecting of bibliographic sources on children's rights and citizenship; The second one, based on the empirical one, was related to the first one. It consisted in the investigation of the MSE implementation model implemented in the city of São Carlos / SP, a reference in the application of socio-educational measures and protection of children's rights.
