Previous issue date: 2015 / O direito da criança e do adolescente no Brasil consolida-se como um ramo jurídico autônomo do Direito, responsável pela incorporação da doutrina da proteção integral ao sistema normativo pátrio a partir da aprovação da Constituição da República Federativa do Brasil de 1988. O estudo da proteção integral aos direitos de crianças e adolescentes compreende também realizá-lo sob o enfoque da igualdade racial e da luta antirracista no Brasil. A atual condição de miserabilidade econômica e de invisibilidade sofrida pelos negros no Brasil é reveladora do reflexo de uma violência real e simbólica, da discriminação racial, por vezes velada, pela qual sofrem diariamente milhares de pessoas negras no País, incluindo crianças e adolescentes. Por isto, esta pesquisa tem como objetivo geral verificar se os direitos humanos e fundamentais de crianças e adolescentes negros são promovidos à luz da doutrina da proteção integral e se estão elas assistidas pelas políticas públicas de garantia da igualdade racial no Brasil. O problema de pesquisa se relaciona com o seu objetivo geral, uma vez que a questão norteadora desta tese é verificar se o paradigma da proteção integral alcançou as crianças e os adolescentes negros, e se eles estão contemplados nas políticas públicas, inclusive aquelas que visam à garantia da igualdade racial e ao reconhecimento de suas identidades. A pesquisa tem como objetivos específicos: a) estudar a teoria crítica dos direitos humanos e dos direitos fundamentais com enfoque no direito de igualdade; b) compreender as relações raciais no Brasil, bem como o processo de luta antirracista no que envolve seus aspectos jurídicos e sociais; c) analisar a doutrina da proteção integral no sistema normativo brasileiro sob a perspectiva da igualdade racial para a garantia dos direitos de crianças e adolescentes negros no Brasil; d) pesquisar os Planos Decenais de Direitos Humanos de Crianças e Adolescentes e perceber o processo de invisibilidade de crianças e adolescentes negros na construção de políticas públicas que garantam a igualdade racial; e) pontuar os principais desafios e perspectivas para a garantia de direitos de crianças e adolescentes negros no Brasil contemporâneo, no que se referem às políticas de igualdade racial como meio instrumental na luta antirracista e como contribuidoras para a simetria das relações raciais desde a infância. O método utilizado foi o indutivo, e procedimento monográfico, envolvendo a técnica de pesquisa bibliográfica e documental.<br> / The right of children and adolescents in Brazil is consolidated as an autonomous legal branch of Law, responsible for the incorporation of the doctrine of full protection to parental normative system from the approval of the Constitution of the Federative Republic of Brazil 1988. The study of full protection of the rights of children and adolescents also comprises carrying it out from the standpoint of racial equality and anti-racist struggle in Brazil. The present condition of economic misery and of invisibility suffered by black people in Brazil reveals the reflection of a real and symbolic violence, of racial discrimination, sometimes veiled, because of which thousands of black people in the country suffer daily, including children and adolescents. Therefore, this study has the general objective to verify if human and fundamental rights of black children and adolescents are promoted in the light of the doctrine of full protection, and they are assisted by public policies to guarantee racial equality in Brazil. The research problem relates to its general objective, since the main question of this thesis is to verify if the paradigm of full protection reached black children and adolescents and if they are included in public policies, including those aimed at ensuring racial equality and recognition of their identities. The research has the following specific objectives: a) studying the critical theory of human rights and fundamental rights focusing on the right to equality; b) understanding race relations in Brazil, as well as the anti-racist struggle process involving their legal and social aspects; c) analyzing the doctrine of full protection in the Brazilian legal system from the perspective of racial equality for the guarantee of black children and adolescents? rights in Brazil; d) searching the Decennial Plans on Human Rights of Children and Adolescents and notice the process of invisibility of black children and adolescents in the construction of public policies that guarantee racial equality; e) punctuating the main challenges and prospects for guarantee of black children and adolescents? rights in contemporary Brazil, regarding racial equality policies being an instrument in the anti-racist struggle and as contributors to the symmetry of race relations since childhood. The method used was the inductive, with monographic procedure method, involving the bibliographical and documentary research technique.
