Previous issue date: 2008-02-19 / The objective of this study is finding a way to bind civilly and criminally a public agent that
fails to comply with a judicial order. For that, it addresses the topic Separation of Powers, the
interferences of a Power with the others, conflicts resulting from overlapping functions, and
interventions of a Power in the others. It provides a chapter especially focused on the
Judiciary Branch, its role under the Constitution of 1988, in particular with respect to its
mission of acting as an arbitrator for conflicts between Powers. It also makes a historical
analysis of all Brazilian Constitutions with regard to the way how each of them addresses the
Separation of Powers and the Judiciary Branch. / O presente trabalho constitui um estudo, cujo objetivo é buscar uma fórmula de como
responsabilizar, civil e criminalmente, o agente público que descumprir uma ordem emanada
pelo Poder Judiciário. Para tanto, aborda o tema Separação de Poderes, as interferências que
um Poder exerce sobre os demais, os conflitos advindos do entrelaçamento de funções bem
como as ingerências que um Poder exerce sobre os outros. Traz um capítulo especialmente
voltado para o Poder Judiciário, o seu papel diante da Constituição de 1988, sobretudo no que
concerne a sua incumbência de ser o árbitro dos choques existentes entre os Poderes. Faz
também um estudo histórico de todas as constituições brasileiras no que se refere ao
tratamento de cada uma delas sobre a Separação de Poderes e o Poder Judiciário.
