El siguiente informe tiene por finalidad exponer el análisis trabajado en base a las cuestiones jurídicas identificadas en el Expediente No. 528149-2013/DSD (en adelante, el “Expediente”), mediante el cual se tramita la acción de cancelación por falta de uso del registro de la marca JUNIOR en la clase 38 de la Clasificación Internacional de Productos y Servicios Niza, promovido por Disney Enterprises Inc., de Estados Unidos de América (en adelante, “DISNEY”), representada por el estudio Barreda Moller Abogados de Perú, contra Wilson Eduardo Valle Dianderas (en adelante, el “señor Valle Dianderas”). Por tanto, el presente trabajo contiene la descripción de los antecedentes y los hechos relevantes del proceso; así como un análisis de los principales temas jurídicos abordados y una síntesis de mi opinión sobre el caso en general. / The purpose of the following report is to present the analysis worked on based on the legal issues identified in File No. 528149-2013 / DSD (hereinafter, the “File”), through which the cancellation action due to lack of use is processed. of the registration of the JUNIOR trademark in class 38 of the International Classification of Nice Products and Services, promoted by Disney Enterprises Inc., of the United States of America (hereinafter, "DISNEY"), represented by the law firm Barreda Moller Abogados de Perú, against Wilson Eduardo Valle Dianderas (hereinafter, “Mr. Valle Dianderas”).
