Previous issue date: 2013-03-26 / This study seeks to propose an approach to the evidentiary relevance of police investigative actions in first degree murders. First, this study undertakes a general analysis of the criminal investigation components. Secondly, we examine a case under investigation in light of the preliminary investigation, especially with respect to objective and subjective evidence. Finally, in the concluding chapter, we tackle the issue of the validity of evidence collected during police investigations. This study attempts to demonstrate that law enforcement fulfils a paramount function within the social and legal realms if carried out pursuant to technical, legal, and ethical precepts. Additionally, this paper sought to unveil the deep-rooted, frequently negative bias against law enforcement, for in the legitimate exercise of its functions, the police seldom curtail citizens privacy. This paper also defended the police investigation as a safeguard to the individual rights and guarantees of the party under investigation. Above all, this paper attempts to highlight how crucial evidence collected during investigations is to solving crimes by decisively bringing about defendant s guilt or innocent verdicts. The proposed theme was developed through the deductive method, based on the Federal Constitution, Penal Code, Code of Criminal Procedure, and other material bibliographic references. This research was developed based on both indirect documents such as statutes, and secondary sources such as other bibliographic references / A pesquisa faz uma abordagem acerca do valor probat?rio dos atos do inqu?rito policial no crime de homic?dio doloso, iniciando atrav?s da an?lise dos elementos gerais da investiga??o criminal e do inqu?rito policial. Num segundo momento, busca enfrentar a quest?o probante relacionada ? investiga??o preliminar, especialmente quanto ? prova objetiva e subjetiva. Por fim, estuda acerca da pol?mica do valor probat?rio dos atos do inqu?rito policial. O trabalho procurou destacar a import?ncia que a atividade policial possui no cen?rio social e jur?dico, quando guiada de acordo com os preceitos t?cnicos, legais e ?ticos. Tentou desmistificar, tamb?m, a vetusta vis?o acerca do trabalho policial, o qual, por sua caracter?stica n?o raro invasiva ? esfera privada dos cidad?os, muitas das vezes torna-se sujeito a preconceitos de toda a ordem. Postulou, ainda, em favor do inqu?rito policial, como instrumento da salvaguarda das garantias individuais do investigado. Mas, acima de tudo, buscou real?ar acerca da import?ncia que o material probante, inclusive o colhido na fase investigativa, possui na resolu??o do fato criminoso, com forte capacidade de desencadear a condena??o ou absolvi??o do r?u na fase processual. O tema proposto foi desenvolvido atrav?s do m?todo dedutivo, com a base de estudo na Constitui??o Federal, C?digo Penal, C?digo de Processo Penal e bibliografia referente ao assunto.
