This study intends to comprehend many legal controversies, environmental and
economical, that involve the legal reserve institute of rural properties that lack native
vegetation, mainly the legal reserve set in condominium, with RPPN, according to the
legislation of Minas Gerais state. In Minas Gerais, cornerstone of this study, law n.
14.309/2002 (state Forest Code) while determines the institution of legal reserve in
20% of the rural property, in its article 17, brings specific hypothesis of compensation
to properties that lack native vegetation. Among these alternatives, we point out the
one described in incise VI, which allows the owners the acquisition of non contiguous
properties (even in another basin) in condominium, which area is equivalent to the
total sum of the legal reserve of all the co-owners with the institution of the Natural
Property Private Reserve (RPPN). This hypothesis of compensation will be the main
object of this study, which has been developed using the techniques of documental
and bibliographic research, and also the intensive direct field observation and
interviews. Besides the controversy that surrounds the debate regarding the
determination or not to institute legal reserve in properties that lack native vegetation,
with antagonist opinions about the legal interpretation, there is one about the
constitutionality of this rule mentioned, considering that Minas Gerais state has
concurrent jurisdiction to rule. This study will also point out the environmental impact
caused by this compensatory alternative brought by the Minas Gerais law, its positive
and negative aspects. It will also be presented economical data regarding the
adoption of the compensatory legal reserve and its impact in the financial lives of the
rural property owners and of the cities involved, under the analyses of economical
activity reduction and environmental ICMS payment. / Este estudo visa à compreensão das várias controvérsias jurídicas, ambientais e
econômicas que cercam o instituto da reserva legal para as propriedades rurais
desprovidas de vegetação nativa, principalmente daquela instituída em condomínio,
com instituição de RPPN, nos termos preditos pela legislação estadual mineira. Em
Minas Gerais, foco deste estudo, a Lei nº 14.309/2002 (Código Florestal do estado),
ao tempo em que obriga a instituição de reserva legal em 20% do imóvel rural, no
seu artigo 17, traz hipóteses específicas de compensação para as propriedades
carentes de vegetação nativa. Dentre estas alternativas, enfoca-se a descrita no
inciso VI, a qual permite aos proprietários a aquisição de propriedade não contígua
(até mesmo em outra bacia hidrográfica), em regime de condomínio, cuja área
corresponda à soma total da reserva legal de todos os condôminos ou coproprietários,
com a instituição de Reserva Particular do Patrimônio Natural (RPPN).
Tal hipótese de compensação será o objeto principal deste estudo, o qual foi
desenvolvido com a utilização de técnicas de pesquisa documental e bibliográfica, e
de observação direta intensiva no campo e realização de entrevistas. Além da
controvérsia que envolve o debate sobre a obrigatoriedade ou não de se instituir
reserva legal nos imóveis carentes de vegetação nativa, com posições antagônicas
sobre a interpretação legal, existe uma que versa sobre a constitucionalidade ou não
da norma estadual supracitada, visto que o Estado de Minas Gerais detém
competência concorrente para legislar. Este estudo versará também sobre os
impactos ambientais ocasionados pela alternativa compensatória trazida pela Lei
Mineira, seus aspectos positivos e negativos. Serão também apresentados dados
econômicos inerentes à adoção da reserva legal compensatória e seus impactos na
vida financeira dos proprietários rurais e dos municípios envolvidos, sob a ótica da
redução da atividade econômica e do repasse do ICMS Ecológico. / Mestre em Geografia
