Orientador: Alexandre Walmott Borges / Banca: Murilo Gaspardo / Banca: Thiago Gonçalves Paluma Rocha / Resumo: Este trabalho propõe o debate sobre a importância da motivação dos atos sancionatórios - seja judicial ou administrativo, seja punitivo ou absolutório, sobretudo na seara administrativa militar, ou administrativa disciplinar militar, com todas as suas peculiaridades e princípios próprios, tais como a hierarquia e a disciplina - para a demonstração e para o exercício da justiça. Anseio que será alcançado com o emprego da argumentação jurídica, com suas técnicas e regras, a qual possibilita a construção de um discurso racional, ponderando-se os princípios. Inicia-se com um debate sobre a deontologia e a natureza da função militar, sua situação no ordenamento jurídico-constitucional atual. Em seguida, será abordada a teoria do processo administrativo a partir da teoria geral do processo, com os apontamentos sobre as peculiaridades constatadas antes e depois da vigência da constituição de 1988, culminando na análise do ato administrativo - como uma consequência do processo - seus elementos e requisitos, com ênfase no motivo, como um dos elementos essenciais do ato administrativo, e na motivação, como um princípio do ato administrativo sancionatório e a imperiosa incidência de tais regras sobre o ordenamento administrativo militar. Chega-se então ao debate sobre a teoria da argumentação jurídica e o controle judicial dos atos sancionatórios nesse prisma, com abordagem de algumas questões sobre a justiça do ato sancionatório, que será legitimado na medida em que estiver alinhado co... (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: This work proposes the debate on the importance of motivating sanctions - whether judicial or administrative, whether punitive or absolutory, especially in the administrative military field, or administrative disciplinary military, with all its peculiarities and principles of its own, such as hierarchy and Discipline - for demonstration and for the exercise of justice. I hope that it will be achieved with the use of legal argumentation, with its techniques and rules, which enables the construction of a rational discourse, pondering the principles. It begins with a debate on the deontology and the nature of the military function, its situation in the current juridical-constitutional order. Next, the theory of the administrative process will be approached from the general theory of the process, with the notes on the peculiarities verified before and after the validity of the constitution of 1988, culminating in the analysis of the administrative act - as a consequence of the process - its elements And requirements, with emphasis on the motive, as one of the essential elements of the administrative act, and motivation, as a principle of administrative sanctioning act and the imperative incidence of such rules on military administrative order. The debate on the theory of legal argumentation and judicial control of sanctions acts in this prism, with an approach to some questions about the justice of the sanctioning act, which will be legitimized insofar as it is in line with the current legal system and with The values and ideals adopted by society, aiming at consolidating the Democratic State of Law.
