275859.pdf: 1962146 bytes, checksum: c5db55fafbac6f1d06019f05760792c4 (MD5) / O presente trabalho propõe-se a identificar e avaliar situações de conflito entre a ocupação do solo urbano e a legislação, a realizar uma análise histórica da ocupação do solo na área de estudo, confrontando-a com as seguintes legislações: Estatuto da Cidade, Código Florestal Brasileiro, o Plano Diretor do Município e o Plano de Desenvolvimento Integrado da Região Metropolitana de Curitiba (PDI-RMC). Tem o objetivo geral de subsidiar a análise e decisão das instituições governamentais quanto à definição de novos parâmetros ou identificação de novas áreas de interesse de proteção dos mananciais de abastecimento público, visando à exclusão da Bacia do Baixo Pequeno como área de manancial de abastecimento da Região Metropolitana de Curitiba. Possui também o objetivo de verificar a ordenação do crescimento do Município de São José dos Pinhais, especificamente a área denominada de Baixo Pequeno, analisando a ocupação atual e o crescimento ocorrido no período de 1996 a 2006, avaliar as relações entre a produção do espaço e a proteção dos mananciais efetuando a análise do histórico de ocupação da área, o qual é cotejado com as políticas públicas incidentes, particularmente no que se refere ao ordenamento. Para tanto a metodologia utilizada será a de revisão bibliográfica e documental. Os resultados indicaram que o enfrentamento da problemática de disponibilidade e reserva de área para manancial de abastecimento público e a gestão desses instrumentos na RMC deve estar em consonância com diretrizes propostas pelo governo do Estado do Paraná, para o desenvolvimento, preservação e conservação do meio ambiente, articulado com diretrizes e mecanismos operacionais, instrumentos relativos ao funcionamento dinâmico das grandes metrópoles. / The purpose of this study consists in identify and evaluate conflict situations between the occupation of the ground urban and the legislation, to carry through a historical analysis of the occupation of the ground in the study area, being collated it with the following legislation: Estatuto da Cidade, Código Florestal Brasileiro, Plano Diretor do Município and Plano de Desenvolvimento Integrado da Região Metropolitana de Curitiba (PDI-RMC). It has the general objective to subsidize the analysis and decision of the governmental institutions how much to the definition of new parameters or identification of new areas of interest of protection of the sources of public supplying, aiming at to the exclusion of the Low Basin of the Small one as area of source of supplying of the Region Metropolitan of Curitiba. It also possess the objective to verify the ordinance of the growth of the City of Are Jose of the Pinhais, specifically the Low called area of Small, analyzing the current occupation and the growth occurred in the period of 1996 the 2004, to develop a applicatory one of GIS (Geographic Information System) to identify the distribution of the population of São Jose dos Pinhais, referring to the years of 1996 the 2004, to proceed a evolution boarding from the use and occupation of the ground, as well as of the quality of the water for the years of 1996 the 2004, to evaluate the relations between the production of the space and the protection of the sources effecting the analysis of the description of occupation of the area, which is cotejado with the incident public politics, particularly as for the order. For in such a way the used methodology it will be of documentary bibliographical revision and, as well as field research. The results indicated that the to face of the problematic of availability and reserve of area for spring of public supply and the management of these instruments in the RMC must be in harmony with directives proposed by the government of the State of the Paraná, for the development, preservation and conservation of the environment, articulated with directives and operational mechanisms, relative instruments to the dynamic functioning of the great metropolises.
