Defesa: Curitiba, 06/04/2017 / Inclui referências : f. 145-148 / Área de concentração : Direitos humanos e democracia / Resumo: O presente estudo tem como tema a análise das relações entre trabalho e tecnologia a partir da crítica ao determinismo tecnológico e a neutralidade da técnica. O trabalho se debruça sobre as teorias da relação entre tecnologia e sociedade, com vistas a realizar uma aproximação do direito a essa corrente de pensamento crítico. A investigação submete o direito, disciplina do trabalho e a tecnologia na América Latina ao questionamento do progresso tecnológico e da neutralidade da técnica. A compreensão de tecnologia apresentada se posiciona longe de todas as tentativas de determinações unilaterais construídas hegemonicamente pela sociedade. Corroborando a crítica ao determinismo, a tecnologia não se estabelece como um ente autônomo capaz de salvar a sociedade dos males do trabalho, não caminha em direção à um incontestável progresso tecnológico, bem como não tem possibilidade de decidir os rumos do futuro da humanidade. Em perspectiva similar, não será possível a utilização do artefato tecnológico de modo neutro, a depender da vontade política dos agentes que o dominarem. Para a análise da relação entre tecnologia e trabalho, defendemos uma perspectiva relacional, com o arcabouço de uma gama de elementos (econômicos, políticos e sociais) e agentes distintos que interagem na sociedade, não tardando a evidenciar o contexto da sociedade pautada no modo capitalista de produção e reprodução da vida. Assim, a tecnologia é construída pelos humanos organizados em sociedade, e o próprio corpo do artefato tecnológico possui política. O padrão de reprodução particular da América Latina, as relações de classe, a dominação de investimentos e a escolha de tecnologias a serem desenvolvidas, bem como os objetivos de introdução da maquinaria para superexploração, aparecem na politização da tecnologia. A crítica da tecnologia aplicada ao direito e ao trabalho pode ser vista sob a ótica da disputa social dos rumos da tecnologia, com fim no almejado controle social da produção pelos trabalhadores. Palavras-Chave: trabalho; tecnologia; determinismo; neutralidade; / Abstract: The theme of this thesis is the analysis of the relation between work and technology from the criticism of the technological determinism and technical neutrality. This work focuses on the theories of the relation between technology and society, trying to introduce this critical chain of thought to the law studies. This investigation puts law, work discipline and technology in Latin America under the analysis and questions of the technological progress and technical neutrality. The understanding of technology presented here is far from all other attempts of unilateral definitions built hegemonically by society. Corroborating the determinism critics, technology is not established as an autonomous entity that can rescue society from the harms of work, it does not go towards an unquestionable technological progress as well as it cannot decide the course of society's future. In a similar perspective, it will not be possible to use the technological artefact in a neutral way, subordinated to the political will of dominant agents. To analyse the relations between technology and work, we defend a relative perspective with the theoretical framework of a myriad of economical, political and social elements and distinct agents that interact in society, not tarrying to point the context of a society lined in the capitalist model of both production and reproduction of life. Thus, technology is built by socially organized humans and the own body of the technological artefact posesses politics. The Latin American standard of reproduction, the investments dominations and the choice of technologies to be developed, as well as the goals to introduce machinery for overexploitation, appear in the politicization of technology. The criticism of technology applied to Law and work can be seen by the lens of social dispute for the directions of technology, with the aim to have the very much longed for social control of the production by the working class.
