Actualmente, resulta importante crear un escenario de debate en la que se pueda
discutir sobre la necesidad de que se pueda regular en el Perú un estatuto de
derechos y obligaciones del propietario del suelo, a través de un instrumento
normativo matriz -como bien podría serlo una Ley de Suelos. Es por esta razón que
el presente trabajo de investigación pretende identificar los derechos y obligaciones
del propietario del suelo en el marco de la función social de la propiedad. Para ello,
se determinará de forma previa si la función social de la propiedad tiene
reconocimiento en nuestro ordenamiento jurídico.
Para el desarrollo del presente artículo, se ha recurrido al derecho comparado con
la finalidad de realizar un análisis comparativo y crítico de lo regulado en el Perú,
respecto de los ordenamientos jurídicos de países como España, Argentina, Brasil
y Colombia. En el Perú, en tanto existen profesionales del derecho y el urbanismo
que han desarrollado investigaciones sobre la necesidad de una Ley de Suelos,
abordaremos aquellos análisis para desarrollar nuestra propuesta de investigación. / Currently, it is important to create a forum for debate in which it is possible to discuss
the need to regulate in Peru a statute of rights and obligations of the property owner,
through a principal normative instrument -as could well be a Soil Law. It is for this
reason that this research work aims to identify the rights and obligations of the land
owner within the framework of the social function of property. For this, it will be
determined in advance if the social function of the property is recognized in our legal
system.
For the development of this article, comparative law has been used in order to carry
out a comparative and critical analysis of what is regulated in Peru, with respect to
the legal systems of countries such as Spain, Argentina, Brazil and Colombia. In
Peru, while there are legal and urban planning professionals who have developed
research on the need for a Soil Law, we will address those analyzes to develop our
research proposal.
