Previous issue date: 2017-05-22 / O presente trabalho tem como objetivo analisar o papel da Comiss?o Nacional da Verdade
(CNV), institu?da atrav?s da Lei N?. 12.528 de 18 de novembro de 2011, pela presidente
Dilma Rousseff, com o intuito de apurar as graves viola??es de direitos humanos, afim de
efetivar o direito a mem?ria e a verdade hist?rica. Tomamos o seu Relat?rio Final como
principal fonte de pesquisa, o documento que cont?m mais de 4 mil p?ginas, dividido em tr?s
volumes. O primeiro traz um panorama da repress?o, apresentando o modus operandi da
ditadura, os agentes respons?veis por viola??es como tortura, estupro, execu??es e oculta??o
de cad?ver e recomenda??es que congregam medidas para o avan?o na pol?tica de efetiva??o
dos direitos humanos e da democracia no Brasil. O segundo volume traz textos tem?ticos e
aborda quest?es como a repress?o contra ind?genas, comunidades campesinas, militares,
igrejas crist?s, dentre outras. O terceiro volume ? exclusivamente dedicado ?s v?timas da
ditadura, elucidando as circunst?ncias da morte e desaparecimento de 434 casos. Analisamos
a comiss?o e seu relat?rio, tendo como principal instrumental te?rico o materialismo
hist?rico. Neste sentido, foram fundamentais os seguintes autores: Marx (1996, 2009) Walter
Benjamin (1987), Henri Lefebvre (2013), Ellen Wood (2011), Noam Chomsky (2003), Mike
Davis (2008), Noberto Bobbio (1986), Osvaldo Coggiola (2016), Celso Furtado (1973),
Florestan n (2015), Weffort (1989), Milton Pinheiro (2014) e Spinelli (2014). A Comiss?o,
que trabalhou por dois anos e sete meses, revelou um panorama de continuidade de graves
viola??es de direitos humanos, tais como a tortura difusa e cont?nua e a execu??o
extrajudicial, promovidas por agentes dos organismos de seguran?a do Estado. Partindo do
objetivo geral do trabalho, que foi o de identificar se a Comiss?o cumpriu suas metas definas
em Lei, as principais constata??es estabelecidas foram que a comiss?o logrou ?xito na sua
miss?o institucional, revelando o atraso do Brasil em mat?ria de direitos humanos, analisamos
ainda que o processo de transi??o democr?tica e a governabilidade de coaliz?o no Brasil, em
especial suas caracter?sticas, implicaram por formar as limita??es da pr?pria Comiss?o
Nacional da Verdade e do desenvolvimento da democracia brasileira. / The purpose of this paper is to analyze the role of the National Truth Commission (CNV),
established through Law no. 12,528 of November 18, 2011, by President Dilma Rousseff, in
order to investigate serious violations of human rights, in order to realize the right to memory
and historical truth. We take your Final Report as the main source of research, the document
containing more than 4000 pages, divided into three volumes. The first presents a panorama
of repression, presenting the modus operandi of the dictatorship, the agents responsible for
violations such as torture, rape, executions and concealment of corpses, and recommendations
that bring together measures for the advancement of the policy of human rights and
democracy in Brazil . The second volume brings thematic texts and addresses issues such as
repression against indigenous peoples, peasant communities, military, Christian churches,
among others. The third volume is exclusively devoted to the victims of the dictatorship,
elucidating the circumstances of death and disappearance of 434 cases. We analyze the
commission and its report, having as main theoretical instrument historical materialism. In
this sense, the following authors were fundamental: Marx (1996, 2009) Walter Benjamin
(1987), Henri Lefebvre (2013), Ellen Wood (2011), Noam Chomsky (2003), Mike Davis ,
Osvaldo Coggiola (2016), Celso Furtado (1973), Florestan (2015), Weffort (1989), Milton
Pinheiro (2014) and Spinelli (2014). The Commission, which has been working for two years
and seven months, has shown a continuity of serious human rights violations, such as
widespread and continuing torture and extrajudicial execution, carried out by agents of State
security agencies. Based on the overall objective of the work, which was to identify whether
the Commission met its legal goals, the main findings were that the commission succeeded in
its institutional mission, revealing Brazil's human rights backlog, That the democratic
transition process and the governability of coalition in Brazil, especially its characteristics,
imply for forming the limitations of the National Commission of Truth itself and the
development of Brazilian democracy.
