Previous issue date: 2012-03-29 / Considering the evident lack of effectiveness and legitimacy of the widely disseminated idea of rehabilitation through punishment, this dissertation analyzes the concepts that intend to justify the existence and purposes of prison as a form of punishment through the principles that guide the current State (democratic, secular, legal, Republican), as well as through the elements of international recognition of citizenship (dignity, freedom, autonomy of conscience), and also taking into consideration principles that enable the construction of a humanist Criminal Law. Reaching for a special kind of prevention, known as positive special prevention , one can verify that in reality there are excesses in the application of the prison punishment, and therefore this work seeks to find conditions that, even though still ideal, would allow actual rehabilitation to happen. This dissertation offers a critical, current, democratic view on the various notions of punishment, particularly on those which seem to be legitimized due to a rehabilitation speech, in order to build an alternative that may agree with the founding principles of a Democratic State. / Tendo em vista a aparente inefic?cia e ilegitimidade da t?o propagada ideia da ressocializa??o atrav?s da pena nos dias de hoje, pretende-se analisar as concep??es que intendem justificar a exist?ncia e as finalidades da pena, a partir de um olhar guiado pelos princ?pios que norteiam e fundamentam a concep??o atual de Estado (Democr?tico, Laico, de Direito, Republicano), bem como atrav?s dos elementos internacionais de reconhecimento da cidadania (dignidade, liberdade, autonomia da consci?ncia), tamb?m considerados, ? claro, os princ?pios formadores de um Direito Penal humanista. Chegando-se ? preven??o especial positiva, verificam-se excessos que ultrapassam os limites estabelecidos, e busca-se um espa?o poss?vel, mas ideal, porque ainda inexistente, de sua concretiza??o. A presente disserta??o permite visualizar as concep??es te?ricas da pena, e em particular aquelas que pretendem se legitimar atrav?s do discurso da ressocializa??o, a partir de uma an?lise que se pretende cr?tica, atual, democr?tica e cidad?, chegando-se ? alternativa que mais se amolda aos princ?pios fundantes do Estado Democr?tico de Direito.
