O estudo foi dividido em três capítulos, cada qual subdividido em três subtítulos. No
primeiro capítulo, há uma análise acerca das inúmeras mudanças sociais e
constitucionais experimentadas na América Latina nas últimas décadas, pois
referidos acontecimentos históricos redundaram em releituras constitucionais que
originaram uma nova ordem jurídica. Textos meramente formais cederam espaço
para cartas políticas de conotação prescritiva, baseadas em uma cidadania efetiva
que deu voz a povos historicamente desconsiderados, o que mudou a forma de
relacionamento, ao menos no campo normativo, entre o homem e a lei, bem como
entre o homem e o meio ambiente. Além disso, a fim de compreender quais os
fundamentos que vinculam o homem ao meio ambiente, há uma análise do tema à
luz do Direito natural e da própria dignidade da pessoa humana, circunstâncias que
reforçam a relevância e a universalidade do direito de todos a um meio ambiente
sadio. No segundo capítulo, o estudo envereda pela trilha dos movimentos
ambientais patrocinados pelas comunidades mais pobres nas últimas décadas, com
ênfase na análise das necessidades humanas básicas na dimensão ambiental e nas
formas de vinculação entre os pobres e o meio ambiente, relação que depende do
aprimoramento da cidadania para evoluir. Por fim, já no terceiro capítulo, o estudo se
ocupa dos efeitos práticos da relação entre os pobres e o meio ambiente na
sociedade moderna, especialmente sob o enfoque do consumo excessivo, das
distorções sociais decorrentes de tal realidade e da face perversa do sistema
econômico dominante. / The study was divided into three chapters, each of them subdivided into three
sections. The first chapter is an analysis related to many social and constitutional
changes experienced in Latin America in the last decades, considering these
historical events had resulted in new constitutional readings that originated a new
legal order. Simply formal texts gave way to federal constitutions with prescriptive
connotation, based on an effective citizenship that gave voice to people historically
disregarded, which changed the way of relationship, leastwise in the normative field,
between man and the law, as well as between man and the environment.
Furthermore, intending to understand witch are the elements that link man to the
environment, there is an analysis of the topic from the perspective of Natural law and
the human’s dignity, circumstances that reinforce the relevance and universality of
the right for everyone to have a healthy environment. In the second chapter, the
study was driven by environmental movements sponsored by the poorest
communities in the last decades, with emphasis on the analysis of basic human
needs in the environmental dimension and linking between poor people and the
environment, which depends of the citizenship ‘s improvement to evolve. Lastly, in
the third chapter, the study is concerned with the practical effects of the relationship
between poor people and the environment in modern society, especially about the
overconsumption, social distortions arising from such reality and perverse face of the
dominant economic system.
