A crítica jurídica tem como importantes instrumentais teóricos e práticos os conceitos gramscianos de hegemonia, ideologia, sociedade civil, sociedade política, teoria do Estado ampliado, intelectual orgânico, partido, guerra de posição, bloco histórico e senso comum. Estão presentes no texto as observações sobre o direito, com destaque para as considerações elaboradas nos Quaderni. As distinções entre a teoria do direito tradicional, hegemônica, e a proposta crítica, contra-hegemônica, são identificadas e contextualizadas no cenário histórico, político e cultural brasileiro, bem como as recentes transformações ocorridas na legalidade estatal, a partir da crise do Estado intervencionista e da globalização econômica que o fulmina. Nesse contexto, são expostas as implicações do pensamento gramsciano, pertinentes para a teorização e a prática alternativa e pluralista de novas juridicidades, as quais podem contribuir para a evolução democrática da sociedade brasileira. A contribuição de Gramsci para teoria do direito induz para uma evolução democrática, capaz considerar as pautas e as contribuições político-juridicas advindas das classes subalternas, limitadas historicamente à pobreza política, para qual contribui o formalismo jurídico tradicional. Demonstra-se no trabalho a importância da teoria crítica brasileira para afirmação de direitos positivados, bem como para a concepção de novos direitos. Palavras-chave: Ideologia. Direito. Estado. The proposal of this dissertation is to present the theoretical categories elaborated by Gramsci, relating them to the critical theory of Law, to which it is relevant. The juridical critic has as important theoretical and practical instruments the concepts presented by Gramsci concerning de hegemony, ideology, civil society, political society, open State theory, organic intellect, political party, position war, historical block and common sense. The observations about Law are present in the text, with highlight for the considerations elaborated in the Quaderni. The distinctions between the traditional and hegemonic Law theory and the critical proposal, counter-hegemonic, are identified and contextualized in the Brazilian historical, political and cultural scenery, as well as the recent transformations which occurred in the state legality, based on the crisis of the interventionist State and the economic globalization that affects this State. In this context, the implications of Gramsci#s thoughts are exposed, which are pertinent for the theorization and the alternative and plural practice of new juridical decisions, which can contribute for the democratic evolution of the Brazilian society. Gramsci#s contribution for the theory of Law induces to a democratic evolution, which is able to consider the topics and the political-juridical contributions which come from the subaltern classes, historically limited to the political poverty, to which the traditional juridical formalism contributes. It is demonstrated in the present paper the importance of the Brazilian critical theory for the affirmation of positive Law, as well as the conception of new Law.
