Previous issue date: 2009-06-17 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / The present study moves forward on the analysis of several phenomena of the world concert for, finally, to suggest a New international Order founded in the proposal of a World Constitution. For so much, we left of the premise of the enlarged international society, conformed by many subject of international Right, which are: the original ones, States; derived them, international organizations; plus, still, the no-government organizations; the multinationals and the individual. The extent of performance of the Right international rejuvenated is verified in the world globalize - phenomenon this observed under wide aspect, not just economical, but also social, cultural, finally, human. The human being is coarctate to bunches normative altered for the structuring of the international Right of the human rights, mainly after to Second World War, what generated, beside the formation of the community Right the reflection of the paper of the State in the century XXI and of the sovereignty, identifiable in first moment as attribute of the State; however that it suffered changes in his/her content - tends as pillar the human person's dignity as norm-origin of the juridical order. The international community's reconstruction should observe the historical and political events that marked him/it begin of the new millennium - for opportune, the terrorist attacks of September 11, 2009 and their consequences. They are not acceptable retreats in Human Rights - the false binomial terrorism versus safety; State of Right versus of Police - they are not acceptable as valid options. The community's reconstruction crosses that challenge in the option for the democracy, in the rejection the war, in the statement of the Right as multilateral road of minimum consensus. Finally, a proposal of world Constitution should be lived under some premises: i) the formation of a systemic and open material content; ii) the human person's dignity and the right international jus cogens. Everything by the formation monist of the Right under the primacy of the international Right. A world Constitution for an universal man / O presente estudo avança sobre a análise de fenômenos diversos do concerto mundial para, por fim, sugerir uma Nova Ordem internacional fundada na proposta de uma Constituição Mundial. Para tanto, partimos da premissa da sociedade internacional ampliada, conformada por plúrimos sujeitos de Direito internacional, quais sejam: os originários, Estados; os derivados, organizações internacionais; mais, ainda, as organizações não-governamentais; as multinacionais e o indivíduo. Verifica-se o âmbito de atuação do Direito internacional redivivo no mundo globalizado fenômeno este observado sob aspecto amplo, não apenas econômico, mas também social, cultural, enfim, humano. O ser humano está coarctado a feixes normativos convolados pela estruturação do Direito internacional dos direitos humanos, principalmente após a Segunda Guerra Mundial, o que gerou, ao lado da formação do Direito comunitário a reflexão do papel do Estado no século XXI e da soberania, identificável em primeiro momento como atributo do Estado; porém que sofreu mudanças em seu conteúdo tendo como pilar a dignidade da pessoa humana como norma-origem da ordem jurídica. A reconstrução da comunidade internacional deve observar os acontecimentos históricos e políticos que marcaram o inicio do novo milênio por oportuno, os ataques terroristas de 11 de setembro de 2009 e suas conseqüências. Não são admissíveis retrocessos em Direitos Humanos o falso binômio terrorismo versus segurança; Estado de Direito versus Estado de Polícia não são aceitáveis como opções válidas. A reconstrução da comunidade atravessa esse desafio na opção pela democracia, no repúdio a guerra, na afirmação do Direito como via multilateral de consenso mínimo. Por fim, uma proposta de Constituição mundial deve ser vivenciada sob algumas premissas: i) a formação de um conteúdo material sistêmico e aberto; ii) a dignidade da pessoa humana e o jus cogens internacional.
