Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES / The research aimed to trace an itinerary of the changes in the patrimonial value in Brazil from an analysis of the changes in the legislation and the social context of the different phases of the national patrimonial policy. Given the diversity of elements that can be considered as patrimony and the historical change of what is or is not considered as equity, the present study required, in a first moment, to define and conceptualize the patrimony field, raising the thesis that the concept of patrimony does not refers to a category of things, but to a type of value judgment. Although the thesis has found reverberation in the property legislations and in the bibliography of the area, both infested with the use of the word value and its variations, determining what should be preserved or not from the justification of a value, studies are scarce to understand the consequences of this routine association between patrimony and value, to meet this need, one of the objectives was to start from the study of the concept of value in the social sciences. Issues judgments of patrimonial value change in different social contexts, choosing different elements for the patrimonial tipping, what is constant is the idea that the patrimonial tipping presupposes a recognition of a judgment of value of certain cultural good through the action of attribution of value by a cultural apparatus that is configured in acts such as tombamento and registration. The patrimonial value is a specific type of attribution of value articulated with the intention of valorization of the national identity, but for that purpose instrumentalizes other types of values, especially the artistic, the historical and the cultural. A bibliographical research was carried out on the patrimony in Brazil, listing the main authors and the historical evolution of the concept of patrimony in Brazil since the preliminary of Mário de Andrade, the period of "Stone and Cal", until the present moment in which ethnic groups they claim their memories and identities through the attribution of patrimonial value. The survey and documentary analysis of the main patrimonial legislations of the country was based on a dialogue between theoretical reflections, value judgments and their reflexes in legal procedures, reflecting on what concerns legal changes sought to respond and what these changes reveal about each context Social. The work used as a criterion of pertinence for the analysis the value changes in the texts of the laws and the itinerary of the laws led to the typification of the values instrumented in the patrimonial policies in artistic, historical, artistic-historical, cultural and its ramifications. / A pesquisa teve como objetivo traçar um itinerário das mudanças do valor patrimonial no Brasil a partir de uma análise das mudanças nas legislações e do contexto social das diferentes fases da política patrimonial nacional. Dada a diversidade de elementos que podem ser considerados patrimônios e a mudança histórica do que é ou não considerado patrimônio, o presente estudo necessitou, em um primeiro momento, definir e conceituar o campo de patrimônio, levantando a tese de que o conceito de patrimônio não se refere a uma categoria de coisas, mas a um tipo de juízo de valor. Apesar de a tese ter encontrado reverberação nas próprias legislações patrimoniais e na bibliografia da área, ambas infestadas do uso da palavra valor e suas variações, determinando o que deve ser preservado ou não a partir da justificativa de um valor, são escassos os estudos que procuram entender as consequências dessa associação rotineira entre patrimônio e valor. Para suprir essa carência, partiu-se do estudo do conceito de valor nas ciências sociais. A sociedade emite juízos de valor patrimonial em contextos sociais diversos, elegendo elementos diferentes para o tombamento patrimonial, o que é constante é a ideia de que o tombamento patrimonial pressupõe um reconhecimento de um juízo de valor de determinado bem cultural através da ação de atribuição de valor por um aparato cultural que se configura em atos como o tombamento e registro. O valor patrimonial é um tipo específico de atribuição de valor articulado com o intuito de valorização da identidade nacional, mas que para esse fim instrumentaliza outros tipos de valores, em especial o artístico, o histórico e o cultural. Foi realizada pesquisa bibliográfica acerca da temática patrimonial no Brasil, elencando os principais autores e a evolução histórica do conceito de patrimônio no Brasil desde o anteprojeto de Mário de Andrade, o período de “Pedra e Cal”, até o momento atual em que grupos étnicos reivindicam suas memórias e identidades através da atribuição de valor patrimonial. O levantamento e análise documental das principais legislações patrimoniais do país se pautou em um diálogo entre as reflexões teóricas, os juízos de valor e seus reflexos nos procedimentos legais, refletindo sobre quais preocupações as mudanças legais procuraram responder e o que essas alterações revelam sobre cada contexto social. O trabalho utilizou como critério de pertinência para a análise as alterações do valor nos textos das leis e o itinerário das leis levou a tipificação dos valores instrumentalizados nas políticas patrimoniais em artístico, histórico, artístico-histórico, cultural e suas ramificações. / São Cristóvão, SE
