I fastighetsmäklarbranschen är det idag brukligt att som fastighetsmäklare använda sig av standardavtal i samband med överlåtelser. Dessa avtal utvecklas i tre steg innan det når den enskilde fastighetsmäklaren, en så kallad utvecklingskedja. Utvecklingskedjan består av Mäklarsamfundets förbundsjurister, systemutvecklare samt fastighetsmäklarföretag. Dessa tre aktörer har möjlighet att redigera avtalets innehåll till det bästa möjliga, samtidigt som det finns en risk att innehållet på ett eller annat sätt blir felaktigt under utvecklingens gång. Som sista steg i utvecklingskedjan finns fastighetsmäklaren, en part som har personligt ansvar för allt hen gör och i slutändan ansvarar för alla tidigare aktörer i utvecklingskedjan. Syftet är att undersöka vilken problematik som kan förekomma för fastighetsmäklare som använder sig av standardavtal samt att genom en diskussion nå en djupare förståelse för standardavtalens utvecklingskedja i förhållande till fastighetsmäklarens personliga ansvar. Uppsatsen visar att problematiken med standardavtalet är dess utvecklingskedja och att fastighetsmäklarens användning av standardavtalen gör att hen, i och med sitt personliga ansvar, får ansvara för alla steg i denna kedja. En orsak till denna problematiken skulle kunna vara att fastighetsmäklare fäster stor tillit till standardavtalen och de aktörer, inklusive förbundsjurister på Mäklarsamfundet, som utvecklat det. Vilket i sin tur kan leda till problem för kontraktsparterna. Standardavtalen håller i huvudsak hög kvalitet och tjänar sitt syfte, men samtidigt kvarstår problematiken med fastighetsmäklares tillit till dessa avtal. Det största problemet vid utformning av kontraktshandlingar är troligen inte standardavtalen i sig, utan snarare antalet aktörer som är involverade i utvecklingskedjan samt fastighetsmäklarens okunskap vid tillämpning av standardklausuler. / In the real estate industry it is customary, as a real estate agent, to use standard agreements when it comes to real estate transactions. These standard agreements are developed in three steps before reaching the real estate agent, a so-called development chain. The development chain consists of lawyers from Mäklarsamfundet, Software developers and real estate companies. These three actors have the ability to edit the content of the agreements but at the same time there remains a risk that the content in one way or another becomes faulty during the development. The real estate agent is the last actor in the development chain and has a personal responsibility for all their actions and are therefore also responsible for all previous actors in the development chain.The aim of this paper is to investigate the issues which emerge for real estate agents who use standard agreements and also to discuss the development chain of the standard contract in relation to the real estate agent's personal responsibility. The paper shows that the problem with the standard agreement is the development chain and that real estate agents, when using these agreements, end up being responsible for all the previous steps in this chain due to their aforementioned personal responsibility.A reason for this problem could be that the real estate agents have a high level of confidence in the standard agreements quality and also in the actors who developed it, including the lawyers from Mäklarsamfundet. In certain cases this can in turn cause problems for the contract parties. The standard agreements are essentially of high quality and serves its purpose, while the problem of the real estate agents high confidence in the agreements remain. When creating the standard agreement the main issue is probably not the standard agreement itself, but the many actors involved in the development chain and the real estate agent's lack of knowledge in applying these standard clauses.
