Previous issue date: 2017-12-09 / The present dissertation examines the sustainability of the development of organized
economic activities in a network of suppliers, subcontractors and contracts, involving
inputs needed to achieve the social object of the final destination company, verifying
the concomitant search for economic, social and environmental aspects. It is based
on the premise that guaranteeing a minimum level of quality, balance and
environmental security is necessary for the realization of life at decent levels, placing
the protection of the various aspects of the environment in the international legal
order and in the Brazilian constitutional and jus-labor infraconstitutional plans, in
order to promote, at all links in the modern production chain, the fundamental right to
the environment of balanced, healthy and safe work. After discussing the governing
principles of International Environmental Law, it is stated that the business agent
must consider the internalisation of negative externalities caused by its economic
activity, in favor of the socio-environmental well-being of the workers involved, which
is why it must identify the interested parties with whom (stakeholders), through the
analysis of the external environment affected by the development of its enterprise,
promoting processes and techniques of sustainable management of suppliers,
subcontractors and contracts. It states that any form of productive outsourcing, to be
sustainable in the long term, must be maintained under strict socio-environmental
control of the contracting company, in order to promote the rights necessary for the
well-being and healthy quality of the worker's life, through the creation and
maintenance of environments that can prevent accidents, injuries and occupational
diseases, aiming at decent work, in the concept advocated by the International Labor
Organization. At the end, it defends the hypothesis that the non-compliance with the
legal obligation of environmental protection in the supply chain, by the company
economically relevant in this dynamic, attracts the incidence of the institute of civil
liability, covering the payment of damages for environmental damage, both individual
and collective and material and moral. / A presente disserta????o examina a sustentabilidade do desenvolvimento de
atividades econ??micas organizadas em rede de fornecedores, subfornecedores e
contratos, envolvendo insumos necess??rios para o atingimento do objeto social da
empresa destinat??ria final, verificando a busca concomitante de aspectos de
natureza econ??mica, social e ambiental. Parte da premissa de que a garantia de um
patamar m??nimo de qualidade, equil??brio e seguran??a ambiental ?? necess??ria para a
concretiza????o da vida em n??veis dignos, situando a prote????o dos diversos aspectos
do meio ambiente no ordenamento jur??dico internacional e nos planos constitucional
e juslaboral infraconstitucional brasileiros, de modo a se promover, em todos os elos
da cadeia produtiva moderna, o direito fundamental ao meio ambiente do trabalho
equilibrado, saud??vel e seguro. Ap??s tratar dos princ??pios dirigentes do Direito
Ambiental Internacional, exp??e que o agente empresarial deve considerar a
internaliza????o de externalidades negativas ocasionadas por sua atividade
econ??mica, em prol do bem-estar socioambiental dos trabalhadores envolvidos,
raz??o pela qual deve identificar as partes interessadas com quem se relaciona
(stakeholders), atrav??s da an??lise do ambiente externo afetado pelo
desenvolvimento do seu empreendimento, promovendo processos e t??cnicas de
gest??o sustent??vel de fornecedores, subfornecedores e contratos. Fundamenta que
qualquer modalidade de externaliza????o produtiva, para ser sustent??vel a longo
prazo, deve ser mantida sob rigoroso controle socioambiental da empresa
contratante, de modo a promover os direitos necess??rios ao bem-estar e ?? sadia
qualidade de vida do trabalhador, atrav??s da cria????o e manuten????o de ambientes
que possam prevenir acidentes, les??es e enfermidades profissionais, visando o
trabalho decente, no conceito preconizado pela Organiza????o Internacional do
Trabalho. Ao final, defende a hip??tese de que o descumprimento do dever jur??dico
de tutela labor-ambiental na cadeia produtiva, pela empresa economicamente
relevante nessa din??mica, atrai a incid??ncia do instituto da responsabilidade civil,
abrangendo o pagamento de indeniza????es por dano ambiental, tanto individual e
coletivo quanto material e moral.
