The best interests of the child should be a primary consideration in matters of custody, residence, and access. The assessment of the best interests of the child should in particular consider the risk of the child being harmed and the child's need for a close contact with both parents. In addition, the child has a right to be informed and to express his or her views. Allegations of domestic violence are common in custody disputes. If such allegations are made during the proceedings, a risk assessment should always be carried out to assess whether there is a risk of harm to the child. Nevertheless, allegations of violence are rarely considered in the handling of custody disputes. The results of a review of applicable law as well as an empirical study of case law show that this is mainly due to legislative deficiencies. The prospects for conducting in-depth investigations of violence in custody disputes are limited by the fact that investigative procedures require consent from the parents. Furthermore, there is no clear method for assessing and evaluating allegations of violence in the context of custody proceedings. These deficiencies are reflected in the application of the law by the courts, where allegations of violence are often dismissed or excluded. There is a need for reform to ensure that the child perspective and the rights of the child are considered in the handling of custody disputes where allegations of violence are made. One possible solution is to always open a child protection investigation if allegations of domestic violence are made, since a child protection investigation is not limited by the consent of the parents. Other possible improvements include the development of a methodological support for evaluating allegations of violence, and a clarification of the courts' obligation to promote consensual solutions. / Barnets bästa ska vara avgörande i frågor om vårdnad, boende och umgänge. I bedömningen av barnets bästa ska särskilt beaktas risken att barnet far illa och barnets behov av en nära och god kontakt med båda föräldrarna. Utöver detta har barnet även en rätt att få information och ges möjlighet att framföra sina åsikter. Uppgifter om våld inom familjen är vanligt förekommande i vårdnadstvister. Framkommer det uppgifter sådana uppgifter vid handläggningen bör en riskbedömning alltid göras, för att bedöma om det finns en risk att barnet far illa. Trots det beaktas uppgifter om våld sällan vid handläggningen av vårdnadstvister. Resultaten från en granskning av gällande rätt samt en empirisk undersökning av underrättspraxis visar att detta främst orsakas av brister i lagstiftningen. Förutsättningarna att genomföra djupgående utredningar av våld vid handläggningen av en vårdnadstvist begränsas av att inhämtande av uppgifter är beroende av föräldrarnas samtycke. Det saknas vidare en tydlig metod för hur uppgifter om våld ska bedömas och bevisvärderas inom ramen för ett vårdnadsmål. Dessa brister får genomslag i domstolarnas rättstillämpning, där uppgifter om våld ofta avfärdas eller utesluts. Det föreligger ett behov av reformer för att barnperspektivet och barnrättsperspektivet ska få genomslag vid handläggningen av vårdnadstvister där uppgifter om våld framförts. En möjlig lösning är att alltid inleda en barnavårdsutredning om det framkommer att det kan ha förekommit våld inom familjen, eftersom möjligheterna att inhämta uppgifter i sådan inte är begränsade av föräldrarnas samtycke. Andra möjliga förbättringar inkluderar ett utarbetande av ett metodstöd samt ett förtydligande av domstolars skyldighet att verka för en samförståndslösning.
