Previous issue date: 2016-06-30 / The dissertation aims to verify that the new Marco Third Regulatory Sector (Law 13,019
/ 14) ensures that civil society organizations are democracy implementation instrument
in Brazil, since they carry out activities with the purpose of guaranteeing individual
rights, efficiently and relevant social interest. Throughout history it was observed that
the sociopolitical order was composed basically of two sectors: the State, represented
by the Public Administration and the society and the market, represented by the private
sector. These sectors both in terms of their personality and their characteristics are
very different. The first provides social interest and being a legal entity under public
law, is subject to the legal regime of public law. The second sector has a faster
performance, more efficient, since it is subject to the legal framework of private law,
but their actions are aimed at profit. Organizations, research object, belong to the third
sector, are legal persons of private law, carry out activities of social interest, but do not
earn profit. Law 13,019 / 14 brought greater autonomy to civil society organizations,
which now have more recognition and appreciation by society and the State. Besides,
it brought new rules to ensure its sustainability, transparency in relations with the state
and methods of supervision and control more efficient. / A disserta????o tem por finalidade verificar se o Novo Marco Regulat??rio do Terceiro
Setor (Lei 13.019/14) garante que as Organiza????es da Sociedade Civil sejam
instrumento de concretiza????o da democracia no Brasil, posto que realizam atividades
com finalidade de garantir direitos individuais, de forma eficiente e de relevante
interesse social. Ao longo da hist??ria p??de-se observar que a ordem sociopol??tica foi
composta basicamente por dois setores: o Estatal, representado pela Administra????o
P??blica e pela sociedade e o Mercado, representado pela iniciativa privada. Estes
setores tanto em rela????o ?? sua personalidade quanto ??s suas caracter??sticas, s??o bem
distintos. O primeiro presta servi??os de interesse social e sendo pessoa jur??dica de
direito p??blico, est?? sujeito ao regime jur??dico de direito p??blico. J?? o segundo setor,
possui uma atua????o mais c??lere, mais eficiente, vez que se sujeita ao regime jur??dico
de direito privado, por??m suas a????es visam a obten????o de lucro. As organiza????es,
objeto da pesquisa, pertencem ao Terceiro Setor, s??o pessoas jur??dicas de direito
privado, realizam atividades de interesse social, por??m n??o auferem lucro. A Lei
13.019/14 trouxe maior autonomia ??s Organiza????es da Sociedade Civil, que passam
a ter mais reconhecimento e valoriza????o por parte da sociedade e do pr??prio Estado.
Al??m do que, trouxe novas regras para garantir sua sustentabilidade, transpar??ncia
nas rela????es com o Estado e formas de fiscaliza????o e controle mais eficientes.
