Previous issue date: 2018-08-03 / The present study aimed to analyze the current reflexes of the Examination of Order on the teaching practices in the Law courses in Fortaleza. It is a qualitative research, with field research conducted during the months of June and July 2018 in four legal education institutions in the city of Fortaleza / CE, being conducted interviews with course coordinators, students and teachers from each institution, with the objective of identifying the importance of the Examination of the Order for the definition of the legal education model of each IES, as well as its reflexes in teaching practices inside and outside the classroom, investigating its compatibility with the guidelines of the Ministry of Education. We used specialized literature to understand the historical and political aspects that permeated the origin of legal education in Brazil, of the Brazilian Bar Association and the Order Examination. The documentary research included investigation of historical documents, legal decisions, resolutions and specific legislation, as well as the analysis of the current model of proof of the Examination of the Order, with a view to identifying the justifying grounds which led to the institution of this in Brazil. It was verified that in all the private institutions of higher education there are political-pedagogical instruments of preparation for the Examination of the Order, within the IES itself, in parallel with the academic legal training. The deficiency of the formation of the bachelor in the face of the dogmatic, reductionist and juspositivist teaching that has been offered during the decades in the courses of Law, currently has as its most evident parameter the approval of the student in the Examination of the Order, to be an important evaluation index for the institution before the market of private higher education. Market. / O presente estudo objetivou analisar os atuais reflexos do Exame de Ordem sobre as práticas de ensino nos cursos de Direito em Fortaleza. Trata-se de pesquisa de natureza qualitativa, com pesquisa de campo realizada durantes os meses de junho e julho de 2018 em quatro instituições de ensino jurídico na cidade de Fortaleza/CE, sendo realizadas entrevistas com coordenadores de curso, alunos e professores de cada instituição, com o objetivo identificar a importância do Exame da Ordem para a definição do modelo de ensino jurídico de cada IES, bem como seus reflexos nas práticas de ensino dentro e fora da sala de aula, investigando sua compatibilidade com as diretrizes do Ministério da Educação. Utilizou-se de literatura especializada para a compreensão dos aspectos históricos e políticos que permearam a origem do ensino jurídico no Brasil, da Ordem dos Advogados do Brasil e do Exame de Ordem. A pesquisa documental abrangeu investigação de documentos históricos, decisões jurídicas, resoluções e legislação específica, além da análise do atual modelo de prova do Exame da Ordem, com vistas a identificar os motivos justificadores que levaram à instituição deste no Brasil. Verificou-se que em todas as instituições privadas de ensino superior existem instrumentos político-pedagógicos de preparação para o Exame da Ordem, dentro da própria IES, em paralelo com a formação jurídica acadêmica. A deficiência da formação do bacharel diante do ensino dogmático, reducionista e juspositivista que vem sendo oferecido ao longo das décadas nos cursos de Direito, atualmente tem como parâmetro mais evidente a aprovação do aluno no Exame da Ordem, por ser um importante índice de avaliação para a instituição perante o mercado do ensino superior privado.
