Previous issue date: 2008-09-05 / The Federal Supreme Court (STF), throughout history, from its foundation, is the target of much criticism because of political decisions often contrary to social interest, to the benefit of government pressure. This study examines the origin of the power of Court, and the relationship of the judiciary with the other powers, identifying some of the reasons why the last instance of the Judiciary operates with supremacy, checking the competence to the action of legal controlling constitutionality and legitimacy of the Municipalities in the above actions, and lastly, evaluate whether the criteria of political and legal action against the STF in front of the Action ADPF, used as an effective control between legislative act and constitutional text. / O Supremo Tribunal Federal (STF), ao longo da história, desde a sua fundação, é alvo de muitas críticas, em virtude de alguns posicionamentos políticos firmados em decisões pouco estáveis e, muitas vezes, contrárias ao interesse social, em benefício de pressões governamentais. O presente trabalho analisa a origem da competência outorgada à egrégia Corte, estuda a relação do Judiciário com os demais poderes, identificando alguns dos motivos pelos quais a última instância do Poder Judiciário atua com supremacia, verifica os meios de controle de constitucionalidade exercidos pela Suprema Corte e a posição dos Municípios, desde sua formação perante as referidas ações e, por fim, avalia a utilização de critérios políticos e jurídicos na atuação do STF ante a Ação de Descumprimento de Preceito Fundamental, utilizada como meio eficaz em matérias de controvérsia municipal diante do texto constitucional.
