Previous issue date: 2012-01-27 / This research reflects about women s social role, their relation to violence based on gender, in the historically preferential condition of victim, and the relation to equality rights under the perspective of the new paradigm of inclusion. In this regard we will begin with the analysis of context and ideology, which marked the appearance of the police forces in Brazil and their historical function, to enable us to perceive the current procedure of celebration of the so called Terms of Well Living in police stations of the state of Maranhão. With regard to the cases of violence against women, the practices of social control and repression of the XIX century remain present even after the enactment of Law no. 11.304/2006, called Maria da Penha Law. The methodology adopted involved bibliographical, desk and field research about the training and performance of the police forces, as well as the history of affirmation of the fight combating violence based on gender against women. The methodology used in the elaboration of this work was a descriptive and analytical study, developed by field and bibliographical research regarding type, a qualitative and quantitative nature and, as for the objectives, descriptive and exploratory. With this investigation the permanency of the so called Terms of Well Living was found as an instrument of reproduction and imposition of traditional representations of women s social role and, for that reason, the permanent tolerance towards domestic violence, this way contradicting the present criminal treatment, more severe, foreseen nationally in the present legislation and also with the international commitments assumed by Brazil, with regard to the combat against violence based on gender and the respect for human rights.

Terms of Well Living / Esta pesquisa reflete sobre o papel social da mulher, sua relação com a violência de gênero, na condição de vítima historicamente preferencial, e a relação com o direito à igualdade sob a perspectiva no novo paradigma da inclusão. Para isso partiremos por meio da análise do contexto e ideologia que marcaram o surgimento das polícias no Brasil e de sua função histórica, para que assim possamos perceber o procedimento vigente de celebração dos chamados Termos de Bem Viver em delegacias de polícia do Estado do Maranhão. No tocante aos casos de violência contra a mulher as práticas de controle e repressão social do século XIX, continuam presentes mesmo após o advento da Lei 11.340/2006, denominada Lei Maria da Penha A metodologia adotada envolveu pesquisa bibliográfica, documental e de campo acerca da formação e atuação das polícias, bem como do histórico de afirmação da luta contra a violência de gênero em face da mulher. O método utilizado na elaboração do estudo constitui-se em um estudo descritivo-analítico, desenvolvido por meio de pesquisa de campo e bibliográfica quanto ao tipo, de natureza qualitativa e quantitativa e, quanto aos objetivos, descritiva e exploratória. Com a investigação verificou-se a permanência dos chamados Termos de Bem Viver como instrumento para reprodução e imposição de representações tradicionais do papel social da mulher e por isso da permanente tolerância à violência doméstica, apresentando assim uma contradição ao tratamento penal vigente, mais severo, previsto na legislação atual em âmbito nacional e ainda com os compromissos internacionais assumidos pelo Brasil, no que concerne ao combate à violência de gênero e respeito aos direitos humanos.
