Previous issue date: 2016-08-29 / The partisan loyalty is not an institution of homogeneous appearance over the years in the brazilian legal system, especially in constitutional terms, given that it has suffered intense modifications until the arrival of the democratization process, which Brazil has experienced. With this said, in the opening lines, this work aims to overlook the conflicts and shortcomings suffered by this institution related with the problems faced by Resolution nº 22.610/2007 of the Superior Electoral Court (TSE), because when followed closely by the Supreme Court (STF), to designate that partisan loyalty would lead the sanction of mandate loss. It created, and legislated and overrode the principle of separation of powers, which has constitutional prevision, acting in perfect illegitimacy and usurping legislative power. An addendum is prescribed from the heart of the coalition presidentialism in order to observe the change of the relationship between executive and legislative branches over time and their influence on loyalty. Then the article discusses whether the just causes of disaffiliation and so famed party windows would be no way to jockey fidelity in their real democratic sense. An interdisciplinarity strategy was added, gathering Constitutional Law, Political Science and Marketing tools - SWOT analysis and BCG matrix - to assert about the strengths and weaknesses, threats and opportunities of the resolution regarding the quality of democracy in the Country. The last hang given in this work gravitates to the orbits of the separation of powers, as support point the party loyalty in Brazil. Thus, this study condenses itself in the contributions of the top names of Political Philosophy, in the close relationship between equality and freedom within a democratic context, and in how the separation of powers must be respected along the lines of the Federal Constitution of 1988 (CF/88) so that it unveils the central issue of this thesis, which is, whether there is a possible balance between the trinomial partisan loyalty, separation of powers and popular sovereignty against brazilian democracy at the conflicts and weaknesses by which passed this institution. Finally, to make this possible, we adopted a methodology that covers a bibliographical study in books, articles, dissertations and thesis, and also have occurred to the Constitutional Law interdisciplinary strategy with the Political Science and Marketing tools. Popular Sovereignty. / A fidelidade partidária é um instituto de aparência não homogênea ao longo dos tempos no ordenamento jurídico brasileiro, principalmente em termos constitucionais, haja vista que sofreu intensas modificações até a chegada do processo de redemocratização, pelo qual passou o Brasil. Com isto, em linhas iniciais, este trabalho visa a dar um giro nos conflitos e insuficiências padecidos pelo instituto em virtude da problemática enfrentada pela Resolução nº 22.610/2007, do Tribunal Superior Eleitoral (TSE), que, ao ser seguida de perto pelo Supremo Tribunal Federal (STF), ao designar que a infidelidade partidária daria azo a sanção de perda de mandato, acabou por criar, legislar e se sobrepor ao princípio da separação de poderes, que possui previsão constitucional, agindo em perfeita ilegitimidade e usurpando a competência legislativa. Um adendo é prescrito do tocante ao presidencialismo de coalizão, a fim de observar a modificação das relações entre Executivo e Legislativo ao longo dos tempos e suas influências na fidelidade. Em seguida, discute-se se as justas causas de desfiliação e as tão afamadas janelas partidárias não seriam maneiras de intrujar a fidelidade em seu real sentido democrático. É acrescida uma estratégia de interdisciplinaridade do Direito Constitucional, Ciência Política e os meios de Marketing - análise SWOT e matriz de BCG - para perquirir acerca dos pontos positivos e negativos, das ameaças e oportunidades no concernente à qualidade da democracia no País. O último enfoque dado no escrito gravita à orbita da separação de poderes, como ponto de equilíbrio a fidelidade partidária no Brasil. Assim, o estudo se condensa nas contribuições dos principais nomes da Filosofia Política, na estreita relação entre igualdade e liberdade em um contexto democrático e em como a separação de poderes deve ser respeitada nos moldes da Constituição Federal de 1988 (CF/88), para que se desvele a problemática central desta dissertação, qual seja, se há equilíbrio possível entre o trinômio fidelidade partidária, separação de poderes e soberania popular ante a democracia brasileira perante os conflitos e insuficiências pelos quais passou o instituto. Por fim, para que isto fosse possível, adotou-se uma metodologia que cobre um estudo bibliográfico em livros, artigos, dissertações e teses, além de haver ocorrido à estratégia de interdisciplinaridade do Direito Constitucional com a Ciência Política e os instrumentos de Marketing.
