on embryonic steam cell has been the great promise made by scientists to society
as far as human health is concerned. Researchers suppose the therapeutic
potential of cell trunk can be possibly used to heal a myriad of diseases.
Aware of this expectation, the acceptability of using human embryo as a
source of steam cell is the main issue brought by this activity. Such research also
leads to legal and ethics dilemmas due to its implication in the destruction of the
embryo and in the view of human being as an apparatus.
The proposal of the present paper is to reflect upon this ambivalent
reality and to reafirm human life as an absolute blessing and further rights as no
more than implications of this supreme value. Thus human life is seen as
intangible, not to be renounced, revoked, prescribed or violated. Therefore any
legitimate scientific action should be based on the respect to the fundamental
right to life and to its inherent dignity / Nos últimos anos, no âmbito da biomedicina, a grande promessa que vem
sendo realizada pelos cientistas à sociedade, no que concerne à saúde humana,
refere-se à pesquisa científica em células-tronco embrionárias. Os pesquisadores
supõem que o potencial terapêutico dessas células poderá ser usado na cura de
diversas enfermidades.
A par dessa expectativa, o problema fundamental que essa atividade
suscita e que conduz a dilemas jurídicos e éticos gira em torno da aceitabilidade
do uso de embriões humanos como fonte de células-tronco. Isso porque essa
utilização implica, até o momento, na destruição do embrião e na
instrumentalização do ser humano.
A proposta do presente trabalho é refletir acerca dessa realidade
conflitante e ambivalente e recordar que a vida humana é um bem absoluto,
pressuposto e requisito dos demais direitos, que possui um valor supremo, que é
intangível, irrevogável, imprescritível, irrenunciável e inviolável e que qualquer
prática científica que se pretenda legítima deve, no respeito ao direito
fundamental à vida e na dignidade que lhe é inerente, buscar sustentação e
fundamento
