Busca-se no presente trabalho examinar o papel do Poder Judiciário no sistema político e sua relação com os demais poderes. O Poder Judiciário tem alguma influência na definição das escolhas políticas do governo, especificamente quanto à política econômica adotada? O judiciário legisla? Para responder a essas questões, estuda-se o sistema judiciário brasileiro e particularmente a função da jurisprudência do Tribunal Superior do Trabalho – TST, especificamente quanto à formação da súmula 331 do TST na regulação da terceirização de serviço e mão de obra no Brasil evidenciando o uso da jurisprudência à solução de conflitos de interesse no que diz respeito a esse fenômeno. Portanto, na prática, o entendimento consolidado do TST, por meio de sua jurisprudência, regula a terceirização de serviços e mão de obra no Brasil, em vez de lei em sentido estrito. Deliberadamente, a jurisprudência dos tribunais superiores tem substituído à lei. Essa jurisprudência tem acompanhado a orientação da política econômica adotada pelo Poder Executivo Federal, e nesse sentido pode-se chamá-la de “Jurisprudência Política”. / Search up in this study to examine the role of the judiciary in the political system and its relationship with the other powers. The judiciary has some influence in setting government policy choices, especially as regards the economic policy adopted? The judicial legislation? To answer these questions, we study the Brazilian judicial system and particularly the role of case law of the Superior Labor Court -TST, specifically regarding the formation of the scoresheet 331 of the TST in the regulation of service outsourcing and labor in Brazil evidencing use of case-law to resolve conflicts of interest with regard to this phenomenon. Therefore, in practice, the consolidated understanding of the TST, through its case law, regulates the outsourcing of services and work hand in Brazil, rather than the law strictly. Deliberately, the jurisprudence of the higher courts have replaced the law. This jurisprudence has followed the guidance of the economic policy adopted by the federal executive branch, and in that sense one can call it "Political Jurisprudence".
