Previous issue date: 2015-04-02 / O presente trabalho realiza uma análise sobre a compatibilidade das diretrizes gerais da política urbana brasileira, expressas na lei 10.257/01 – Estatuto da Cidade, com a teoria de justiça social territorial de David Harvey, o que faz dele um trabalho essencialmente teórico. Os motivos que levaram a buscar verificar a compatibilidade da lei com a teoria de Harvey decorrem do fato de que o Estatuto dispõe em vários artigos que, entre seus objetivos, está à promoção da justiça social nas cidades. Para realizar seu mister, o trabalho se estrutura da seguinte maneira. Na seção 1 é feita a introdução. Nela são apresentados os objetivos da pesquisa, a metodologia utilizada e os principais autores discutidos, bem como a estrutura do texto. Na seção 2 é feita uma discussão sobre o espaço urbano, sua forma de produção e uso de seu solo. Na seção 3 é feita uma discussão sobre justiça social territorial e a política urbana nacional, especialmente, com foco nos princípios da função social da cidade e da função social da propriedade, além da análise de alguns instrumentos legais estabelecidos na lei 10.257/01 e que auxiliam na verificação da compatibilidade. Por fim, na seção 4 são feitas as considerações finais do trabalho. / This paper makes an analysis on the compatibility of the general guidelines of the Brazilian urban policy, expressed in the Law 10.257 / 01 - Statute of the City, with the territorial social justice theory of David Harvey, making it an essentially theoretical work. The reasons to seek verify the compatibility of the law with Harvey's theory stem from the fact that the Statute has in several articles, among its objectives is to promote social justice in the cities. To carry out his profession, the work is structured as follows. In Section 1 the introduction is made. In it the research objectives are presented, the methodology used and the main authors discussed, as well as the structure of the text. In section 2 is made a discussion on the urban space, their way of production and use of its soil. Section 3 is made a discussion of territorial social justice and national urban policy, especially focusing on the principles of social function of the city and the social function of property, as well as analysis of some legal instruments established by law 10.257/01 e that help check the compatibility. Finally, in section 4 are made the final considerations.
