Previous issue date: 2016-05-25 / O presente trabalho acadêmico tem por objeto a verificação dos métodos de justiça restaurativa aplicados no Poder Judiciário do Rio Grande do Sul, como meios hábeis a possibilitar a ampliação do acesso à justiça e da aplicabilidade do princípio da efetividade na concessão de direitos. A partir da análise dos métodos de justiça restaurativa aplicados nas varas da infância e juventude de Porto Alegre e de Caxias do Sul, que, por sua vez, empregam as metodologias da comunicação não violenta (CNV) e dos círculos de construção de paz, respectivamente, buscou-se enumerar as semelhanças e as distinções entre ambas e verificar se alguma dessas formas contribui para o acesso à justiça numa acepção ampla e se há verdadeiramente a efetividade de direitos após a conclusão do processo circular de justiça restaurativa. O alcance do acesso à justiça que se pretende averiguar nessa pesquisa vai além do tradicional acesso ao poder judiciário, de tal modo que se assegure o direito humano à ordem jurídica justa, aí incluídas todas as garantias fundamentais e, principalmente, o direito a uma resolução de conflitos de forma ampla e humanizada, restaurando-se laços rompidos, apontando para o objetivo último de (r)estabelecer uma cultura de paz. De igual modo, pretende-se averiguar a possibilidade de a prática de justiça restaurativa ampliar o sentido atribuído tradicionalmente ao princípio da efetividade, tencionando, assim, superar o critério meramente temporal de duração razoável do processo, para uma efetiva implementação de direitos, em especial os direitos humanos. / This academic work is engaged in the verification of restorative justice methods applied in the Judicial Courts in Rio Grande do Sul State, as expedients to allow increased access to justice and the applicability of the principle of effectiveness in fundamental rights. From the analysis of restorative justice methods applied in the childhood and youth courts of Porto Alegre and Caxias do Sul, employ the methods of nonviolent communication (CNV) and of the peacemaking circle, respectively, it tried to list the similarities and distinctions between both and see if any of these forms contributes to access to justice in the broadest sense and if there is the effectiveness of rights after complete of the circular process of restorative justice. The scope of the access to justice that is intended to find out this research goes beyond the traditional access to the judiciary , so that ensure the human right to fair legal system, there included all the fundamental guarantees and, especially, the right to a resolution of conflict broadly and deeply, restoring the broken ties up with the ultimate goal of re-establishing a culture of peace. At the same time, it intend to investigate the possibility of the practice of restorative justice expand the meaning attributed traditionally to the principle of effectiveness, intending overcoming the temporal attribute of moderate duration of the process, for effective implementation of rights, in particular human rights.
