Previous issue date: 2014-08-27 / Esse ? um estudo que discute o processo de viola??o do direito ? cidade da popula??o em situa??o de rua situada em regi?es centrais da cidade de Natal/ RN, mais especificamente nos bairros da Ribeira e Cidade Alta. Para tanto, desenvolve-se a partir da an?lise do desenvolvimento do modo de produ??o capitalista e nisso, as implica??es desse paradigma de (re)produ??o socioecon?mica para a forma com que se organiza o territ?rio urbano na atualidade. Em um segundo momento, a discuss?o transitar?, partindo da forma??o s?cio-hist?rica brasileira e do conceito do direito ? cidade, de que forma esse vem sendo pensado e garantido na realidade contempor?nea do pa?s, sobretudo quando relacionado ?s pol?ticas sociais urbanas institu?das em uma conjuntura de crise econ?mica do capital. Por fim, o estudo se volta para a discuss?o sobre as condi??es de origem e reprodu??o do fen?meno popula??o em situa??o de rua, no que tange ?s suas caracter?sticas gerais e viola??es vivenciadas no ?mbito do direito ? cidade no Brasil e mais especificamente na cidade de Natal/RN. Com base na Teoria Social Cr?tica, o trabalho em tela foi realizado por meio de pesquisa bibliogr?fica e documental, bem como de registros de materiais obtidos nos encontros e reuni?es realizados pelo Centro de Refer?ncia em Direitos Humanos da UFRN (CRDH/UFRN) em parceria com o Movimento Nacional da Popula??o em Situa??o de Rua (MNPR) e o Projeto ?Direitos Humanos e Popula??o em Situa??o de Rua: A vida pode mais?? e do F?rum Potiguar da Popula??o em Situa??o de Rua, ocorridos entre 2013 e 2014; e nos est?gios realizados entre 2009 e 2011 no Centro de Refer?ncia Especializada de Assist?ncia Social (CREAS) e na Secretaria Municipal de Habita??o, Regulariza??o Fundi?ria e Projetos Estruturantes (SEHARPE). Ademais, para a an?lise que se pretende qualitativa, foram realizadas a observa??o participante, conversas informais nos encontros e reuni?es em que se fez presen?a, e entrevistas semiestruturadas com profissionais e militantes que trabalham com a tem?tica em quest?o, al?m da pr?pria popula??o em situa??o de rua. E, a partir dela, realizou-se uma caracteriza??o e an?lise do perfil constitutivo dessa popula??o no Brasil e em Natal, no que tange aos seus aspectos econ?micos, pol?ticos, sociais e culturais, apreendendo assim, quais os principais direitos dessa popula??o que v?m sendo violados, e problematizando o papel do Estado no ?mbito do direito ? cidade, no que diz respeito ? aus?ncia ou inefici?ncia de pol?ticas sociais voltadas para essa popula??o, mais especificamente nos eixos da sa?de e assist?ncia social; como tamb?m se identificou e analisou-se a exist?ncia de formas de resist?ncia e organiza??o dessa popula??o, no que se refere ? luta pela garantia de seus direitos. / This study discusses the homeless Right to the City violation process in central areas of Natal/RN, specifically at Ribeira and Cidade Alta neighborhoods. To do so, the study is developed from the analysis of the capitalist mode of production development and, in addition, the consequences of this paradigm of socioeconomic (re)production towards how the urban territory is organized today. Later, the discussion will shift, starting from the socio-historical formation of Brazil and from the concept of Right to the City ? how it has been thought out and secured in the conteporary reality of the country, particularly when related to urban social policiesinstituted in a context of economic crisis of capital. Ultimately, the study turns to the discussion on the conditions of origin and reproduction of the homelessness phenomenon, in regard of its general characteristics and experienced violations under the Right to the City in Brasil and, more specifically, in Natal city. Based on Critical Social Theory, this study was conducted through literature and documentary research, as well as through records of materials obtained at the meetingspromoted by UFRN Reference Center for Human Rights (CRDH/UFRN) in association with National Coalition for the Homeless (MNPR); with the project called "Human Rights and Homelessness: Does life get better?" and with Potiguar Forum of Homelessness occurred between 2013 and 2014; as well as in internship experiences between 2009 and 2011 at Specialized Reference Center of Social Assistance (CREAS) and at Municipal Secretary of Dwelling, Land Regularization and Infrastructure Projects. Furthermore ? in order to the intended qualitative analysis ? participant observation was conducted, as well as informal conversations in the meetings of which participated and semistructured interview with activists and professionals who work with the topic at issue, in addition to the homeless themselves. Out of it, weheld a characterization and analysis of the homeless population profile in Brazil and in Natal ? in regard to its economic, political, social and cultural aspects. Thus, it was understood which are the main rights of this population that have been violated, and the government's role under the Right to the City concept was questioned, with regard to the absence or inefficiency of social policies aimed at this population ? More specifically as regards to health and social care; Were also displayed and examined the existence of forms of resistance and organization of this population, regarding to the struggle to ensure their rights.
