Previous issue date: 2015 / Diante da necessidade de construção de uma nova cultura constitucional de integração latino-americana e criação de um diálogo intercultural para efetivação do Direito como elo de transformação para a libertação, o presente estudo propõe-se repensar um novo modelo jurídico, a fim de fazer germinar a semente para uma sociedade mais equitativa, ancorando-se num paradigma comunitário-participativo, em que o equilíbrio e a complementaridade estarão interligados. Ao descortinar-se um novo constitucionalismo, emerge outro projeto político-comunitário, que parte especificamente da América Latina, exigindo um Direito descolonizado, considerando que os movimentos sociais podem ser um mecanismo de desconstrução do direito tradicional, tendo no pluralismo jurídico um mecanismo capaz de fazer o contraponto ao estatismo, com possibilidades dinâmicas e aptas para a proposta de uma educação jurídica epistemologicamente contemporânea, baseada no  bem viver . Nesse sentido, o projeto do  bem viver questiona o Estado predador, hierárquico e individualista, no resgate de uma identidade perdida e que precisa ser reconstituída. Toda essa reflexão vai ao encontro de um desejo de reconstrução da vida, repercutindo nas condições adversas da humanidade, que o modernismo e o capitalismo submergiram. Para tanto, é necessário sair de uma visão monocultural e emergir para os estados plurinacionais, descolonizando-os, posto que imperam baseados numa individualidade que deteriora a capacidade natural do humano, que não é único no mundo, que precisa respeitar a natureza à sua volta, para perceber que tudo vive, está interconectado e é interdependente. O enfrentamento do tema exige determinação. Trata-se de estudo inovador, tendo em vista os aspectos formais que o permeiam  políticos, econômicos, históricos e institucionais, somando-se o capitalismo desenvolvimentista travestido de modernismo  afetando diretamente o objeto da pesquisa e refletindo numa cultura de organização jurídica e educacional dogmatizada e esgotada, que precisa ser recuperada para que a sociedade alcance um paradigma comunitário-participativo no âmbito da educação jurídica. Ao concluir-se a pesquisa, sinaliza-se no sentido de que é possível haver mudança epistemológica, no âmbito da educação jurídica, propondo a renovação dos saberes, levando em conta as experiências sociais vivenciadas em países da América Latina, com base no pluralismo jurídico comunitário-participativo, evidenciando as tendências do Direito a partir da ampliação das demandas populares e do ativismo social, protagonizadas nos novos direitos, na interculturalidade, bem como nas experiências ancestrais, para almejar um equilíbrio com todas as formas de existência.<br> / Abstract : Confronted with the necessity of building a new constitutional culture of Latin American integration, and the creation of an intercultural dialogue for the achievement of the Law, as a link of transformation for the freedom, this study aims to rethink a new legal model in order to germinate the seed for a more equitable society, anchoring in a community-participatory paradigm, in which the balance and the complementarity will be interconnected. While uncovering up a new constitutionalism, a new political and community project emerges, which starts specifically from Latin America, demanding a decolonized Law, considering that social movements can be a deconstruction mechanism of the traditional law, having in the legal pluralism, a mechanism able to make the point against the statism, with dynamic possibilities able to the proposal of a epistemologically contemporary legal education based on the  good living . In this sense, the  good living project questions the predator, hierarchical and individualistic State, in the rescue of a lost identity which needs to be reconstituted. All this reflection meets a desire for the reconstruction of life, reflecting the adverse conditions of humanity, where modernism and capitalism submerged. Therefore, it is necessary to leave a monocultural vision and emerge to the plurinational states, decolonizing them, since they rein based on an individuality which deteriorates the natural capacity of the human being, who is not unique in the world, that needs to respect nature around them, to notice that everything is alive, everything is interconnected and interdependent. Facing the issue requires determination. This is a groundbreaking study considering the formal aspects which permeates it  political, economic, historical and institutional, adding up the developmental capitalism disguised as modernism  which directly affects the research object and reflecting in a culture of legal and educational organization that is dogmatic and exhausted, which needs to be recovered for the society to reach a community-participatory paradigm in the scope of legal education. By concluding this research, it is signaled that it is possible to have epistemological changes, in the scope of legal education, promoting the renewal of knowledge, taking into account the social lived experiences in Latin American countries, based on the community-participatory legal pluralism, highlighting the trends of Law from the expansion of popular demands and social activism, performed in the new rights, in the interculturality, as well as in the ancestral experiences to aim a balance among all the existing forms.
