Previous issue date: 2015 / A história do pensamento é um processo permanente de superação de conceitos, teorias, modos de pensar, de agir e de fazer, motivo pelo qual a Ciência do Direito deve ser modificada juntamente com o processo de transformação social. O pensamento complexo, por meio de suas categorias e princípios basilares, surge como uma alternativa para repensar a realidade e reformular a ciência, sendo necessário o estudo em torno de sua aplicação para o Direito Ambiental. A justificativa desta pesquisa se pauta no enfoque original que se busca oferecer à problemática, tendo em vista que aborda a quebra de paradigmas da modernidade e do cientificismo racionalista, de forma a investigar a possibilidade de aplicação do pensamento complexo ao Direito Ambiental. Nesse sentido, o problema de partida é o seguinte: como a Epistemologia Jurídica pode enfrentar os desafios que a complexidade traz para o Direito Ambiental? O objetivo geral da pesquisa é investigar a possibilidade de novos fundamentos epistemológicos do Direito Ambiental, a partir do pensamento complexo. A metodologia utilizada é o próprio paradigma da complexidade que, a partir dos seus princípios norteadores, é considerado um método científico em construção. As obras utilizadas para a pesquisa no Direito ainda adotam, em sua maioria, o pensamento cartesiano e linear, cujos métodos são inadequados para a proposta apresentada. O desafio epistemológico verificado é a tensão que o conceito de meio ambiente traz para o sistema jurídico, gerando insegurança. Não há como engessar o meio ambiente, pois, como sistema que o é, está submetido aos princípios da autoeco-organização e sistêmico, gerando insegurança. Por outro lado, a desordem/ordem/organização são situações em que a própria Física e a Matemática explicam que decorrem simultaneamente. Não há segurança sem insegurança, o próprio sistema vai ter mecanismos de se autorregular. A busca por respostas conduziram a reflexões que permeiam o pensamento complexo, a Epistemologia Jurídica, a Ética, a Teoria do Direito e o próprio conceito jurídico de meio ambiente. A hipótese central do trabalho é que a indeterminação e a mutabilidade de suas influências endógenas e exógenas fazem com que o meio ambiente, enquanto objeto da relação jurídica, vincule-se aos sujeitos de forma continuada, sendo, portanto, a relação jurídica ambiental continuativa. É preciso romper o imaginário jurídico formal e encaixotado da Epistemologia Jurídica, sendo o diálogo de saberes um caminho possível (e nunca a solução) para uma nova racionalidade jurídica que busque alinhar uma Epistemologia Ambiental a partir da complexidade, na esperança de poder contribuir, de alguma forma, com o Direito Ambiental. Até porque não há avanços sem falhas.<br> / Abstract : The history of thinking is a permanent process of overcoming concepts, theories, ways of thinking, acting and doing, reason why the Science of Law should be modified along with the process of social change. The complex thinking, through its categories and fundamental principles, emerges as alternative to rethink reality and reformulate society. Thus, it is necessary to study its applicability to Environmental Law. The justification of this research is based on the original approach that it intended to apply to the problem, given that it addresses the shift of modernity and rationalist scientism paradigms, so as to investigate the possibility of applying the complex thinking to the Environmental Law. In this sense, the starting problem is the following: How legal epistemology can address the challenges that complexity brings to the Environmental Law? The general objective of the research is to investigate the possibility of new epistemological foundations of Environmental Law from the complex thinking. The adopted methodology is the very paradigm of complexity that, according to its guiding principles, is considered a scientific method in construction. The literary work used to conduct legal research adopt, in its majority, the Cartesian and linear thinking whose methods are inadequate for the presented proposal. The verified epistemological challenge is the tension that the concept of environment brings to the legal system, creating insecurity. At the same time, there is no way t plaster the environment, since it is a system which is subjected to the ecological self-organization and systemic principles, causing uncertainty. On the other hand, disorder/order/organization are situations where the very Physics and Mathematics explain that they happen simultaneously. There is no security without insecurity, the system itself will have self regulation mechanisms. The search for answers led to reflections that permeate complex thinking, Legal Epistemology, ethics, Law Theory and the very legal concept of environment. The central hypothesis of this work is that the uncertainty and mutability of its endogenous and exogenous influences make the environment, as an object of legal relations, continuously linked to the subjects, being, therefore, the environmental legal relation a continuative one. It is necessary to disrupt with the formal and boxed legal imagination of the Legal Epistemology. The dialogue of knowledge is a possible way (and never the solution) to a new legal rationality that seeks to align an environmental epistemology from the complexity perspective, in the hope that it can contribute, somehow, with the Environmental Law. Specially, because there is no progress without failures.
