Previous issue date: 2017 / Esta tese tem como finalidade problematizar sobre a relação entre o Serviço Social e a mediação familiar, para além da perspectiva instrumental, articulando a abordagem metodológica a uma perspectiva de totalidade, guiada pelos preceitos do projeto profissional do Serviço Social brasileiro. Nessa direção, apresentamos mediações enquanto categoria ontológica e reflexiva marxiana consideradas fundamentais entre o Serviço Social e a mediação familiar. A distinção entre mediação familiar e mediação (esta enquanto categoria marxiana), é necessária, por acreditarmos ser fundamental pensar a mediação familiar incorporando a visão crítica entre singular, particular e universal e, para isto, foi necessário recorrer à totalidade. Como resultado, dialogamos com o posicionamento do CRESS-SP e do CFESS, contrários à posição assumida nesta tese, ou seja, não consideram que a mediação de conflitos deva integrar o exercício profissional do assistente social. Definimos três objetivos específicos: o primeiro, pretende demonstrar se estudos sobre a política pública, e o olhar do Serviço Social sobre a política social, contribuem para a análise da Resolução 125/CNJ como política pública; o segundo, com base na literatura produzida pelo Serviço Social, apresentar estudos sobre família(s) que possam contribuir para (re)pensar a mediação familiar; e, o terceiro, fundamentado na literatura sobre mediação familiar, apresentar elementos teóricos fundamentais que se entrecruzam com discussões sobre família(s) e conflitos familiares elaboradas pelo Serviço Social. Para atingir os objetivos, na nossa síntese, com base na pesquisa bibliográfica e no método adotado, buscamos responder o problema de pesquisa relacionado às mediações que acreditamos ser fundamentais entre o Serviço Social e a mediação familiar. / Abstract : This doctoral thesis has the purpose to discuss the relationship between the Social Service and the family medition service beyond a instrumental perspective and coordinating the methodological approach of totality, all of those guided by the principles of the brazilian Social Service. At this orientation, we present mediations -- as an ontological category and with a marxist view --, which are regarded as fundamental at the process between the Social Service and the family mediation. The distinction between the family mediation and the mediation (this as a marxist category) is a necessary distinction, because we believe that is fundamental to think about family mediation embodyng a critical conception between singular, particular and universal. To this end, it was necessary to resort to the totality. As outcome, we dialogue with the positioning of the CRESS-SP and the CFESS, with were contrary to this thesis position. It means they don t consider that the conflict mediation should integrate the professional practice of the social worker. We established three major purposes: the first one intends to demonstrate if studies about the public policy and the approach of the social service view about the social policy contribute to the analysis of the 125/CNJ Resolution as a public policy. The second one, based at the Social Service literature, presents studies about families that can contribute to (re)think the family mediation. And the third one, that has basis at the family mediation literature, presents theoretical elements that are fundamental and cross-connect discussions about families and family conflicts elaborated by the Social Service. To achieve this goals, our report, based on bibliographic research and the method used, intends to answer the problem of research related to the mediations -- that we believe are fundamental between the Social Service and the family mediation.
