A isto se soma a crescente mobilidade dos seres humanos, que introduz as migrações em massa na dinâmica global da Comunidade Internacional. O conceito de cidadania liga-se à posse de direitos políticos e, na era moderna, tem como critério de atribuição a nacionalidade, paradigma que atualmente gera a exclusão de grandes contingentes de pessoas deslocadas de seus territórios nacionais, às quais não se reconhece a titularidade de diversos direitos de cidadania, dos civis aos políticos, passando pelos sociais e econômicos. Neste contexto, a reconfiguração do paradigma da cidadania nacional busca promover também uma adaptação da democracia para permitir a participação política a todos os membros de uma determinada Comunidade política nas decisões que os concernem. Desta forma, seriam criadas as condições para a promoção do reconhecimento das diferenças dos grupos que compõem as Sociedades multiculturais contemporâneas, o que se faz prioritariamente com políticas de integração. Este trabalho verifica se e de que forma a UE, em geral, e a cidadania criada neste bloco, em específico, constituem respostas a estas questões. A análise considera a face excludente que a Europa revela através de sua recente política migratória, que coloca sob suspeita todas as conquistas que a UE colecionou no campo dos direitos humanos ao longo de sua construção. Demonstra assim que a expansão ao âmbito não-estatal da garantia da efetividade dos direitos humanos e do reconhecimento de direitos de cidadania realizadas por essa nova Comunidade jurídico-política regional é insuficiente e não a torna um vetor da transformação do paradigma da cidadania ligada à nacionalidade para incluir como titulares de direitos de cidadania também as pessoas deslocadas de suas Comunidades nacionais. / The transformation process experienced nowadays by the national State has a significant impact on the concept of citizenship. In addition to that, the growing mobility of human beings introduces mass migrations into the global dynamics of the international community. The concept of citizenship is related to the possession of political rights and in the modern era its criterion of attribution is nationality, a paradigm that nowadays generates the exclusion of a great number of people who are dislocated from their national territories and whose ownership of citizenship rights are not recognized. In this context, the reconfiguration of the paradigm of national citizenship also seeks to promote an adaptation of democracy in order to allow all members of a specific political community to have political participation in the decisions that may affect them. Thus, conditions would be created to promote the recognition of the differences between the groups that compose the contemporary multicultural societies, which is primarily achieved through integration policies. This work verifies whether and in what way the EU, in general, and the citizenship created within the block, specifically, constitute answers to these questions. This analysis considers the side of Europe that excludes, revealed by the recent European migration policy that puts under suspicion all the achievements that the EU has collected in the field of human rights throughout its construction. Therefore, this work demonstrates that the expansion beyond the State#s level of the guarantee of the effectiveness of human rights and of the recognition of the citizenship rights achieved by this new judicial-political community is insufficient and does not turn this community into a vector of transformation of the nationality-related citizenship paradigm to include the people dislocated from their national communities also as holders of citizenship rights.
