Previous issue date: 2007-11-12 / O objetivo desta dissertação é lançar o embrião de um modelo dinâmico para avaliar a legitimidade das intervenções armadas coercitivas. Para tanto, será criado um intervalo de maior e de menor legitimidade, com base em indicadores em três níveis (organizações internacionais, Estados e indivíduos) que representam cada uma das três esferas da legitimidade (legal, política e moral, respectivamente). Os indicadores serão testados nos casos da invasão do Iraque em 1991 e em 2003, os quais assumirão diferentes níveis de legitimidade no continuum criado. Procura-se, dessa maneira, contribuir para a atualização da teoria clássica da guerra justa (que apenas considera aspectos legais e morais) e do atual debate sobre a legitimidade das intervenções armadas coercitivas (cuja abordagem estática compreende, tão somente, a total ausência ou presença de legitimidade). _______________________________________________________________________________ ABSTRACT / This dissertation seeks to introduce the origins of a dynamic model for analyzing the legitimacy of the coercive armed interventions. It does so by creating an interval of higher and lower legitimacy based on three-level indicators (international organizations, states and individuals) that represent each of the three spheres of legitimacy (legal, moral and politics, respectively). These indicators will be tested on the intervention in Iraq in 1991 and 2003, which will assume different levels of legitimacy in the continuum created. This work contributes to the aggiornamento of the just war classical theory (which only considers legal and moral aspects) and the current debate on the legitimacy of the coercive armed interventions (whose static approach only comprehends the two extremes: total presence or absence of legitimacy).
