Previous issue date: 2006-12-11 / A presente dissertação analisa a preservação do patrimônio cultural urbano no âmbito municipal, buscando observar como as cidades históricas vêm se estruturando, legal e administrativamente, para gerir o seu patrimônio, no marco da descentralização administrativa proposta pela Constituição Federal de 1988, que atribui competência comum da União, dos Estados, do Distrito Federal e dos Municípios na proteção do Patrimônio Cultural. Por esta razão, adota como referência temporal o período compreendido entre a Constituição Federal de 1988 e os dias de hoje, não se eliminando a possibilidade de referenciar-se a algum exemplo ou fato ocorrido em período imediatamente anterior, pelos seus reflexos e efeito de continuidade no período destacado. Desenvolve-se a partir de uma construção dos pressupostos que orientaram a gestão urbana no período e, por conseguinte, seus reflexos na gestão do patrimônio cultural, destacando-o como diretriz estratégica das políticas de desenvolvimento urbano. Revela o contencioso predominante entre União e Municípios, sobre a competência da gestão urbana e do patrimônio cultural, e reafirma o dever solidário entre os entes da federação sobre o assunto. Na seqüência, a dissertação desencadeia passos, procedimentos, alternativas, condições basilares para a gestão, analisando-os ora pela sua efetiva aplicação, ora pelas possibilidades que oferecem. Assim, são identificados e analisados os instrumentos de regulação, condições operacionais de trabalho, fontes de recursos e as políticas associadas e os mecanismos de controle e monitoramento. Por fim, aplica toda a estrutura do que se denominou cadeia lógica de gestão do patrimônio cultural ao estudo de caso, à cidade mineira de Ouro Preto. Ela foi escolhida em razão de ser emblemática no Brasil nas ações de preservação; por ser Patrimônio Mundial, que potencializa a sua condição de bem protegido, interferindo diretamente no cotidiano do desenvolvimento urbano; e porque o conjunto de interesse histórico-cultural tem significativa representatividade tanto em relação às suas dimensões, como na sua dinâmica concentradora de serviços, comércio, habitação e circulação. Ao longo de toda a dissertação, recorre-se a exemplos de diversas cidades de diferentes portes na aplicação de instrumentos e mecanismos de proteção para melhor compreender a ação ou omissão do poder público municipal, concluindo-se menos por uma postura predominante, mais por um processo incipiente de gestão municipal.
__________________________________________________________________________________________ ABSTRACT / This dissertation is an analysis on the preservation of the urban cultural heritage with respect to the municipality. It is an in depth investigation on how historical cities were structured, both legally and administratively, to manage their heritage as decentralized landmarks as proposed by the 1988 Federal Constitution. A constitution which gave the Federal Government, the State, the Federal District, and the Municipalities a common ability to protect “Cultural Heritage”. Therefore this research will reference the period between the 1988 Federal Constitution and present day; taking into consideration any example or fact immediately previous to this period that could have affected the continuity of the period. The study starts from the presupposed relations that orientated the urban management in a certain period and its reflections in the cultural heritage management, emphasizing them as line of direction of the politics of urban development. It reveals the disagreements between the Federal Government and Municipalities about the competence of the urban management and cultural heritage and reaffirms their duties. In a following part, the dissertation unchains procedures, alternatives, basic conditions of managements, analyzing either their effective application or the possibilities offered by them. Thus there are the identification and analyzes of the regulations, operational conditions of work, sources and its associated politics and methods to control and monitor. At last, it applies “the logical chain of cultural heritage management” to the case study in Ouro Preto. The city was chosen due to its typical preservation actions in Brazil; for its World Heritage denomination, which emphasizes it as a protected property intervening directly in the daily urban development; and finally because it’s historical and cultural interests have a significant representation not only for its dimension but in its concentration of services, commerce, habitation and transit. Along the dissertation, different applications of the methods of protection were observed in various cities with different sizes in order to comprehend the actions or the neglect of the municipal and public authority, concluding less for a predominant position and more for an incipient process of urban management.
