O jus in bello diz respeito às normas e códigos de conduta que devem ser respeitados durante um conflito armado, e é representado principalmente pelas convenções de guerra de Genebra e Haia. Esse modus operandi define como os combatentes devem agir durante os enfrentamentos. Entretanto a própria realidade diária da guerra não se apresenta favorável a qualquer sistema de cooperação (conceito essencial na teoria de regimes) entre os Estados inimigos. Dessa forma, o trabalho investiga a efetivação do regime da ética na guerra e busca compreender a tomada de decisão dos envolvidos em conflitos armados, fundamentalmente no que concerne à moderação de conduta dos combatentes. Nesse sentido, analisamos a relevância dos fatores morais e da normatização internacional para superar essas barreiras intrínsecas da guerra, como agressividade, postura egoísta e maximização dos ganhos, para propiciar o respeito aos princípios humanitários. / This work aims to present a range of understanding on the international regime of ethic in war, most specifically the ethics of jus in bello. Jus in bello refers to rules and codes of conduct that must be observed in the course of warfare and is mainly represented by the war conventions of Geneve and Hague. This modus operandi defines the way the combatents must act during confrontation. Nevertheless, the daily reality of war itself does not incline towards any cooperative system (which is a key concept in the theory of regimes) among enemy States. Thus, the work investigates the performance of the regime of ethic in war and inquires into the process of decision making by those involved in armed conflicts, fundamentally the one which concerns moderating the conduct of combatants. Furthermore, the relevance of moral factors and international regulation to overcoming those barriers intrinsic to war, such as aggressiveness, selfish posture and utilitarianism, in order to facilitate the respect for humanitarian principles.
