Previous issue date: 2009-07-30 / The dissertation treats about the Law n° 10.639/03 that turns obligatory the teaching of the History and Afro-Brazilian Culture in the schools of the Basic Education. She represents a conquest of the claims of the black movement, however its approval only doesn t mean a change in the social relationship, to become necessary collective actions that guarantee its effectiveness in the education system. This study, is questioned, the absence of the policy too that it only isn t current government, but it is understood like a permanent and effective policy in education. For both it will be analyzed the public policy developed in the Maranhão State, it is considering the national policy of promotion of the racial equality in the extent of the education. So, it will be studied the black in the brazilian education; the actions o of the black movement on behalf of the education from a qualitative paradigm of the analysis, is building, thus, the object through the social research. The instruments used in research they were interviews with managers of the education policy of Maranhão, teachers of the state public net, technicians representatives of the Permanent Forum of Education and Ethnic-Racial Diversity, it is totaling fifteen voices that contributed to analysis of the policy actions of promotion of racial equality in education. Therefore, the implementation of the Law n° 10.639/03, in Maranhão, it is challenged the permanent public policies that they to ensure its effectiveness. / A dissertação discorre sobre a Lei nº 10.639/03, que torna obrigatório o ensino da História e Cultura Afro-Brasileira nos estabelecimentos de ensino da Educação Básica. Ela representa uma conquista das reivindicações do Movimento Negro, porém somente sua homologação não significa uma mudança nas relações sociais, tornando-se necessárias ações coletivas que garantam sua efetividade no sistema de ensino. Neste estudo, é questionada, também, a ausência de uma política que não seja ação somente do governo atual, mas que seja de fato compreendida como uma política permanente e eficaz no sistema de ensino. Para tanto serão analisadas as políticas públicas educacionais desenvolvidas no Estado do Maranhão, considerando a política nacional de Promoção da Igualdade Racial no âmbito da educação. Dessa forma, serão estudados o negro no sistema educacional brasileiro; as ações do Movimento Negro em prol da educação; as políticas públicas de ação afirmativa no sistema educacional a partir de um paradigma qualitativo da análise, construindo, assim, o objeto por meio da pesquisa social. Os instrumentos utilizados na pesquisa foram entrevistas com gestores das políticas educacionais do Maranhão, professores da rede pública estadual, técnicos da Secretaria de Estado da Educação e representantes do Fórum Permanente de Educação e Diversidade Étnico-Racial, totalizando quinze vozes que contribuíram para a análise das ações políticas de promoção da igualdade racial na educação. Assim, a implementação da Lei n°10.659/03, no Maranhão, tem como desafio as políticas públicas permanentes que possam garantir sua efetivação.
