Previous issue date: 2012-12-19 / This dissertation, developed within the research line entitled Sistemas Jur?dico-penais Contempor?neos of the Postgraduate Program in Criminal Sciences of the Pontifical Catholic University of Rio Grande do Sul, focuses on the possibility of the concept of collective legal good maintaining a critical function. Such an investigation is relevant since the theory of legal goods seeks to limit the criminal intervention, determining that every crime be structured on the harming of a legal good. So that the limiting function of the criminal law can only be performed if and when the object of protection has criminal dignity and is able to suffer and express this violation. Whereas the collective legal good has less visible outlines and a more abstract content, and considering that they have increasingly been promoted as basis for new crimes, the foundation of its legitimacy, as well as its characteristics and capability of concretion is also examined in order to determine whether the application of the offensiveness rule is possible. The research thus began seeking to find the source of legitimacy of the collective legal good, examining the qualities that must be present in order for it to establish itself as the foundation of a crime and culminating in the identification of his own peculiar characteristics. Afterwards, we sought to determine in what way the collective legal good can be harmed, by means of an analysis centered on the rule of offensiveness. In the end, it was concluded that, as long as equipped with certain characteristics, the collective legal good can carry out a critical function of criminal law, on the condition that it is capable of concretion. / A presente disserta??o de mestrado, vinculada ? linha de pesquisa Sistemas Jur?dico-penais Contempor?neos do Programa de P?s-Gradua??o em Ci?ncias Criminais da Pontif?cia Universidade Cat?lica do Rio Grande do Sul, foca-se na possibilidade de manuten??o da fun??o cr?tica pelo bem jur?dico supraindividual. Uma investiga??o nesses termos releva uma vez que a teoria do bem jur?dico pretende limitar a interven??o penal, determinando que todo delito esteja alicer?ado sobre uma ofensa a um bem jur?dico-penal. De modo que a fun??o limitadora do direito penal s? pode ser desempenhada se e quando o bem objeto da tutela possua dignidade penal e seja capaz de sofrer e expressar uma ofensa. Considerando que o bem jur?dico supraindividual possui contornos menos vis?veis e um conte?do mais abstrato, assim como que t?m sido postulados cada vez mais bens dessa ?ndole como base de novas incrimina??es, procura-se examinar os fundamentos de sua legitimidade, as suas caracter?sticas pr?prias e a sua capacidade de concretiza??o, no intuito de constatar se a aplica??o da regra da ofensividade ? poss?vel. Por isso, a pesquisa iniciou pela busca da fonte de legitimidade do bem jur?dico supraindividual, passando pelas marcas que devem estar presentes para que um bem possa se firmar como eixo do delito e chegando na identifica??o daquelas caracter?sticas que lhes s?o peculiares. Ap?s, procurou-se determinar de que forma a ofensa do bem jur?dico supraindividual pode ser atestada, por meio de uma an?lise centrada na regra da ofensividade. Ao final, concluiu-se que, munido de certas caracter?sticas, o bem jur?dico supraindividual pode exercer uma fun??o cr?tica do direito penal, na medida em que seja concretiz?vel.
