Previous issue date: 2016-12-22 / The present dissertation begins with brief observations about the evolution of the historical
concept of democracy and its theoretical basis, followed by elucidations on the representative
system?s frailties and its direct combination with democracy. The monograph approaches the
State?s democratic evolution and assertion of participatory democracy, within the necessary
coexistence and combination with political representation, as the Democratic State of Law?s
structure. In this perspective, the social participation in the constitutional outline is analyzed
from the fundamental precept of citizenship and other instruments of direct democracy
established by the Federal Constitution. The central theme lies in the defense of social
participation in the State?s organization and management as the citizen?s constitutional
guarantee, which derives from political citizenship and instruments of direct democracy, from
the popular councils until all the democratizing directives of the Democratic State of Law.
The effectiveness of the constitutional guarantee of social participation in the State?s
management is defended by the sufficiency of the constitutional provisions guaranteeing
citizenship and direct democracy, through the understanding of the unnecessary regulation
and its limits, likewise the exemplification of adequate infra-constitutional legislation and
eventual unconstitutionalities by restriction. Concurrently, the State?s power-duty and rulers
are defended on the induction and guarantee of the effectiveness of social participation, as
well as the limits of the institute. Some successful experiences in the State?s management, in
the Executive, Legislative or Judicial Powers are highlighted not only as defense but also to
imprint the importance of social participation. The conclusions find their essence on the
defense of social participation as a constitutional guarantee, necessary and fundamental to the
public management?s democratization, exercised as a citizenship?s fundamental right and
combined with the political representation system. / O presente texto de disserta??o inicia com breves anota??es sobre a evolu??o do
conceito hist?rico de democracia e sua fundamenta??o te?rica, seguido de apontamentos
sobre fragilidades do sistema representativo e sua combina??o a democracia direta. Aborda a
evolu??o democr?tica do Estado e afirma??o da democracia participativa, dentro da
conviv?ncia necess?ria e combina??o com a representatividade pol?tica, como estrutura do
Estado Democr?tico de Direito. Nesse espectro, aprecia-se a participa??o social no plano
constitucional, a partir do preceito basilar da cidadania e outros instrumentos de democracia
direta previstos na Carta Federal. O tema central encontra-se na defesa da participa??o social
na organiza??o e gest?o do Estado como uma garantia constitucional do cidad?o, decorrente
da cidadania pol?tica e instrumentos de democracia direta, desde os conselhos populares e
todas as diretrizes democratizantes do Estado Democr?tico de Direito. A efetiva??o da
garantia constitucional de participa??o social na gest?o do Estado ? defendida a partir da
sufici?ncia das previs?es constitucionais garantidoras da cidadania e democracia direta,
passando pela compreens?o da desnecessidade de regulamenta??o e seus limites, bem como a
exemplifica??o de legisla??es infraconstitucionais adequadas e eventuais
inconstitucionalidades por restri??o. Ao mesmo tempo, ? defendido o poder-dever do Estado e
seus governantes na indu??o e garantia da efetividade da participa??o social, bem como os
limites do instituto. Como defesa e import?ncia da participa??o social, s?o destacadas
algumas experi?ncias exitosas na gest?o do Estado, no plano dos Poderes Executivo,
Legislativo ou Judici?rio. As conclus?es fixam-se na defesa da participa??o social como uma
garantia constitucional, necess?ria e fundamental para a democratiza??o da gest?o p?blica,
exercida como direito fundamental da cidadania e em combina??o com o sistema de
representa??o pol?tica.
