O Estatuto da Cidade, Lei nº 10.257/2001, é o marco legal do direito urbanístico nacional, pois regulamenta o que a Constituição Federal preconiza para as cidades brasileiras. Nesta tese foi pesquisado um conjunto de dados, extenso e objetivo: Pareceres técnicos que analisam inquéritos no Ministério Público do Estado do Rio Grande do Sul, por um período de dez anos, sobre questões urbanísticas. Foi verificado se o Estatuto da Cidade é atendido nas intervenções analisadas. Para tanto foi criada uma metodologia, apresentada no corpo da tese. Os episódios considerados como em desacordo ao marco legal foram classificados e enumerados em 67 eventos. Estes foram então analisados quantitativa e qualitativamente, sob os mais diversos critérios. Obtiveram-se conclusões sobre uma tendência generalizada de não atendimento ao Estatuto da Cidade e de como ele se manifesta, que resulta em consequências conflituosas para as cidades brasileiras. / The City Statute, Law nº 10.257/2001, is the legal landmark for the national urban planning law, as it regulates what the Federal Constitution recommends for the brasilian cities. In this thesis we researched a set of data, extensive and objective: technical rulings which analyze investigations made by the Public Ministry of the State of Rio Grande do Sul, over a period of ten years, on urban planning matters. We checked if the City Statute has been met in the analyzed interventions. To achieve this, we created a methodology, which is presented in the body of the thesis. The episodes considered to be not in accordance with the legal landmark were classified and listed in 67 events. They were then analyzed under the most diverse criteria for their quantitative and qualitative status. The conclusions obtained point to a general pattern of non compliance with the City Statute and how it manifests itself, resulting in conflicting consequences for the brasilian cities.
