Previous issue date: 4 / Nenhuma / A criança e o adolescente entendidos como cidadãos, sujeitos de direitos, têm na Convenção Internacional dos Direitos da Criança, de 20 de novembro de 1989, o estatuto jurídico internacional desta nova concepção, que estabelece um novo paradigma, o Paradigma da Proteção Integral das Crianças e Adolescentes. Transformações em todas as esferas da sociedade brasileira ocorreram e ocorrem para assegurar a efetivação das disposições convencionadas, mas tais transformações não permitem, ainda, a efetivação plena dos direitos garantidos. A educação como Direito Fundamental e Social acompanha a concepção estabelecida no novo Paradigma, mas convive com as contradições que se apresentam à efetivação dos Direitos Humanos, de forma geral, e, de forma especial, dos direitos das crianças e dos adolescentes em nosso país. O Direito à Educação está assegurado como Direito Fundamental na Carta Magna brasileira de 1988 e nas legislações infraconstitucionais, sendo reconhecida a sua importância em documentos internacionais, dos / In the International Convention on the Rights of the Child, of November 20, 1989, children and adolescents have, in their capacity as citizens and with all their due rights, the international legal statute of this new conception, that establishes a new paradigm: the Paradigm for the Full Protection of Children and Adolescents. Changes have been taking place in every sphere of Brazilian society to ensure the effectiveness of the provisions agreed upon, but these same provisions do not yet allow us the full and complete execution of these guaranteed rights. Education as a Fundamental and Social Right, guaranteed and protected under the new Paradigm, is beset by the same contradictions encountered in the execution of Human Rights, as a whole, and especially as they affect children and adolescents in our country.
