Previous issue date: 2009 / This dissertation examines the criminal use of privileged information in the stock market. It begins with a review of the history of the relationship between the state and the economy and the process by which economic order was brought under constitutional regulation. Next, the control of information in the administrative realm is discussed. A number of decisions by the United States Supreme Court and Courts of Appeals are presented to illustrate the evolution of American jurisprudence on the matter of insider trading. The dissertation concludes by looking at the characteristics and configuration of this felony in Brazilian law, as well as the definition of the protected legal interest and an analysis of the legitimacy of penal liability for the use of privileged information in the stock market. / Versa a presente dissertação sobre o crime de uso indevido de informação privilegiada no mercado de capitais. Realiza-se, num primeiro momento, uma passagem histórica pela relação entre o Estado e Economia, seguida do processo de constitucionalização da ordem econômica. Após, apresentam-se questões relativas ao controle da informação no âmbito administrativo. A seguir, expõem-se algumas decisões de Suprema Corte e das Cortes de Apelação dos Estados Unidos como forma de mostrar a evolução da jurisprudência norte-americana no tratamento do insider trading. Por fim, realiza-se uma abordagem sobre o delito no Brasil, características e configurações, assim como a definição do bem jurídico tutelado, chegando-se à análise da legitimidade da tutela penal do uso indevido de informação privilegiada no mercado de capitais.
