Denna fallstudie handlar om en överprövning av en offentlig upphandling där parterna i målet är ett kommunalt fastighetsbolag, Björnekulla Fastighets AB i Åstorp och TAC ett styr och regler företag i Helsingborg. Vi har undersökt vilka fallgroparna har varit och har funnit att utvärderingen av anbuden varit bristfälliga, misstag har gjorts i arbetsgången och ett dåligt juridiskt språk har använts. Vi anser att detta troligen beror på kompetensbrist när det gäller att upphandla enligt LOU.Genom att identifiera fallgroparna i denna fallstudie vill vi tydliggöra den problematik som kan råda vid en upphandling enligt LOU. För att minimera risken för missförstånd mellan den upphandlande enheten och anbudsgivare är det enligt oss viktig att poängtera behovet av eftertanke vid utformning av förfrågningsunderlag och vid utvärdering av anbud. / Difficulties in technical procurement according to The Act of Public Procurement - a case studyThe case study deals with a reconsideration of procurement, the parties in this case is a local government real estate company, Björnekulla Fastighets AB in Åstorp and TAC, a supplier of integrated systems for building automation in Helsingborg. In this case study we have looked in to what the difficulties have been.According too what we found, the assessment of the offers has been defective, mistakes has been done in the procedure of work and a bad legal language has been used. Our belief is that this is the main reason for the causes of their difficulties. This is outmost depending on lack of competence when it comes to procure according too The Public Procurement Act in Sweden.By identifying the pitfalls in this case study we want to distinct the complexity of the problems that can exist with procure according to the Public Procurement Act. To minimize the risk for misunderstanding between the procuring unit and the tender we want to point out the need for reflection when drawing up the contract documents and evaluating the tenders.
