Not believed to be a CIVINS (Civilian Institutions) title. / This thesis analyzes cases of construction litigation involving the U.S. Naval Facilities Engineering Command (NAVFAC) for the period 1982-2003. NAVFAC construction litagation cases were extracted from the historical trail decision record of the Armed Services Board of Contract Appeals (ASBCA). The thesis provides trend data for all "first time" construction litigation cases brought before the board over the last 21 years. A total of 666 cases involving NAVFAC construction contracts were identified over this 21 year period. The characterization of these cases was accomplished through a review and tabulation of ASBCA identified primary causes and a subjective analysis of "root" causes from a random sample extracted from the total population. The random sample data set totals 30 cases and was taken from cases litigated in the last 10 years. Recommendation based on the findings are given to NAVFAC.

The use of performance-based, or incentive based, compensation plans is ubiquitous in the private sector. Private business operates under the belief that the use of incentives leads to increased performance from employees and higher profits for the companies. This study is centered on the function of those performance-based pay plans within the government. Its purpose is to determine if the use of such pay plans is effective, both for the efficiency of government organizations and the motivation of employees. Through the analysis of government documents and organizational plans, and interviews of human resource managers and employees, this study analyzes performance-based pay and its effectiveness in the public sector.

This thesis is in partial fulfillment of a Master of Arts by Coursework and Research Report in International Relations and has been approved by the University of the Witwatersrand. / This research project looks at the relationship between democracy and development according to policies of aid conditionality in Africa. This involves an analysis of major donors, mainly international financial institutions such as the IMF and World Bank as well as bilateral donors, and the evolution of aid conditionality through the theoretical framework of liberal internationalism. This research focuses on both economic and political conditionality but reveals that economic interests are at the heart of conditionality and are always prioritized over political development. This has important implications for democracy and development because development discourse has identified key correlations between the principles of good governance promoted by a democratic system and development. Through an examination of two African case studies, this research shows that aid conditionality, with its emphasis on neoliberal, free-market economic adjustment, has not fostered adequate development with many recipients of such aid qualifying for the Heavily Indebted Poor Countries initiative that provides debt relief in the interest of poverty reduction. Looking forward, sustainable development can only be achieved with equal dedication to all its spheres; political, economic, and social, thereby providing an adequate foundation for increased international cooperation.
