Tipicidade e individualidade : conceitos para uma pré-compreensão sobre o contrato no direito brasileiro

Alves, Magno Flores January 2012 (has links)
Esta dissertação abordará alguns dos conceitos necessários para uma pré-compreensão sobre o contrato no direito brasileiro após a recepção da função social do contrato na cláusula geral do art. 421 do Código Civil. Serão confrontadas as idéias de tipicidade e individualidade no contrato, a partir do que se questionará a teoria empregada como base para a redação do artigo referido e a idéia de unidade do direito contratual brasileiro. / This paper aims at presenting some of the concepts necessary for a pre-comprehension regarding the contract in Brazilian law after the reception of the social function of the contract in general clause of 421 Article from the civil code. Os momentos literários da individualidade moderna na fenomenologia do espírito de Hegel / The literary moments of modern individuality in Hegel\'s phenomenology of spirit

Adriano Blattner Martinho 01 July 2010 (has links)
By highlighting major statements from the Phenomenology of Spirit on the individuality category, this inquiry intends to appreciate the role of literature in understanding the so-called realization of racional self-consciousness through itself. In the first part, Hegels great work is presented as an attempt to depose the transcendental status of subjectivity in modern philosophy. In the second one, its shown how, against other current disciplines, Hegel conceives the human self-creation of individuality, based on the experience of three famous literary characters: Faust, Karl von Moor and Don Quixote.

How do people with a mental health diagnosis construct an identity?

Platt, Suzanne January 2016 (has links)
Psychiatric diagnosis is used to categorise and treat mental health problems in the UK yet is widely criticised for struggling to convincingly categorise the experience of distress and that it is socially constructed from the culmination of historical and cultural interactions. Service-user accounts are varied and there is a paucity of qualitative research that considers the positive and negative effects of labelling. To understand identity construction in the context of a psychiatric diagnosis, the present study recruited 16 participants from a service-user research group and five focus groups were conducted. Transcripts were studied using Foucauldian Discourse Analysis. Two major identities were detected ‘illness identity’ and ‘recovery identity’. Participants drew on multiple and competing discourses and which placed them in the position of patient and/or survivor. Medical discourses were dominant throughout the focus groups and were used in a way to convey the fluidity of the identity and how they related to their diagnosis. The study’s limitations are discussed, together with implications for clinical practice and future research.

Issues of identity and individuality in quantum mechanics

Caulton, Adam January 2015 (has links)
This dissertation is ordered into three Parts. Part I is an investigation into identity, indiscernibility and individuality in logic and metaphysics. In Chapter 2, I investigate identity and discernibility in classical first-order logic. My aim will will be to define four different ways in which objects can be discerned from one another, and to relate these definitions: (i) to the idea of symmetry; and (ii) to the idea of individuality. In Chapter 3, the four kinds of discernibility are put to use in defining four rival metaphysical theses about indiscernibility and individuality. Part II sets up a philosophical framework for the work of Part III. In Chapter 4, I give an account of the rational reconstruction of concepts, inspired chiefly by Carnap and Haslanger. I also offer an account of the interpretation of physical theories. In Chapter 5, I turn to the specific problem of finding candidate concepts of particle. I present five desiderata that any putative explication ought to satisfy, in order that the proposed concept is a concept of particle at all. Part III surveys three rival proposals for the concept of particle in quantum mechanics. In Chapter 6, I define factorism and distinguish it from haecceitism. I then propose an amendment to recent work by Saunders, Muller and Seevinck, which seeks to show that factorist particles are all at least weakly discernible. I then present reasons for rejecting factorism. In Chapter 7, I investigate and build on recent heterodox proposals by Ghirardi, Marinatto and Weber about the most natural concept of entanglement, and by Zanardi about the idea of a natural decomposition of an assembly. In Chapter 8, I appraise the first of my two heterodox proposals for the concept of particle, varietism. I define varietism, and then compare its performance against the desiderata laid out in Chapter 5. I argue that, despite its many merits, varietism suffers a fatal ambiguity problem. In Chapter 9, I present the second heterodox proposal: emergentism. I argue that emergentism provides the best concept of particle, but that it is does so imperfectly; so there may be no concept of particle to be had in quantum mechanics. If emergentism is true, then particles are (higher-order) properties of the assembly, itself treated as the basic bearer of properties.

Att skapa relationer : Humorns betydelse inom omvårdnad / To build relationships : The role of humour in nursing

Sebom, Veronika, Trygg, Erika January 2021 (has links)
Background: The nurse is responsible for all care concerning the patient. The care must be person-centered with a focus on the creation of interpersonal relationships. With sympathy for the patient, the relationship can become more meaningful and humor is allowed to be introduced. Can humor be a contributing factor to a more beneficial care? Aim: The purpose was to describe how humor can be used in nursing in the relationship between nurse and patient. Method: A literature review where we examined 13 qualitative and quantitative research articles published between the years of 2000-2021. These were analyzed with thematic analysis. Results: Five main themes were identified for the results, which were: relationship building, humor as a tool, individuality, humor as a management strategy and a feeling of context. The main themes were divided into eight subthemes. All of these themes were based on the use of humor. The results showed that the use of humor facilitated the lives of patients, reduced their anxiety and gave them a sense of maintained quality of life despite the circumstances they faced. Conclusion: Humor has proven helpful for most purposes in a caring situation, for both patients and nursing staff. Given individual factors and how they affect how humor is received, the phenomenon would be valuable to be able to take part of already in the basic education for nurses.

Městský polyfunkční dům na ulici Křížová, Brno / Multipurpose Town House on Křížová Street, Brno

Šímová, Jana January 2011 (has links)
The aim of the thesis was to design the urban town house in blank space on Krizova street. The blank space is situated on the edge of the Mendel's square, an important transportation node of the city Brno. Spatial and conceptual solutions of the house is based on urban studies of Mendlel's square and its surroundings. The house is designed on a long parcel, which in the urban environment is equivalent to about four houses. Therefore, the house is divided vertically to keep the urban scale. At the same time at both ends it is directly connected to the existing buildings, therefore, different height levels of each mass are designed. Parterre of the house is commercial, as is the same for neighboring houses, in the other floors modern large single deck and maisonettes are designed.
