Houle, Mélanie 09 May 2018 (has links)

Physical element of possession of corporeal moveable property in Scots lawAnderson, Craig January 2014 (has links)
Possession is a legal concept applying in a variety of legal contexts. In Scottish legal literature, however, there is little in-depth writing on the law of possession, and much of the law is uncertain. This thesis is intended to be a contribution to remedying this deficiency as far as one aspect of the law of possession is concerned, the physical element of possession of corporeal moveable property. As part of this, in the hope that this comparative and historical consideration would shed some light on the issues raised, the law of Rome is considered, along with the law of France, Germany and South Africa, as examples of the Civil Law tradition of legal systems drawing on Roman law. English law is also considered. The thesis is thus able to draw on both of the major traditions influencing the development of Scots law, namely the Civil Law and the Common Law. In this way, the thesis is able to consider the extent to which the Scots law on possession has been influenced by these two traditions. The thesis begins giving an outline of the law of possession and the place of the physical element within it. The remainder of the thesis considers in detail the physical element and its role in both the acquisition and the loss of possession of corporeal moveable property. One of the difficulties with this is that many different areas of law use a concept called 'possession', and views differ as to the extent to which it is appropriate to talk of a general concept of possession. It is argued in the thesis that a general test can be developed for the physical element of possession, based on control of the property in a manner consistent with the assertion of a right to the property. This test is then developed through consideration of how it applies in a number of specific factual contexts.

Thesis (LLM)--Stellenbosch University, 1982.
"In the final analysis the protection of possession
is part and parcel of the protection of the peace
in a community, which could not be maintained if
every person who asserts that he has a real right
to a particular thing which is in another person's
possession would be entitled to resort to selfhelp".

Possessed by desire: A.S. Byatt's Possession and its location in postmodernismArthur, Susan Margaret 09 March 2009 (has links)
ABSTRACT
This research report explores A. S Byatt’s ambivalent relationship to postmodernism
through a critical engagement with two of her recent novels, Possession and The
Biographer’s Tale. Both use the techniques, while simultaneously constituting a
critique, of postmodernism. The novels challenge postmodernism, indicating Byatt’s
misgivings about the continuing suitability of this mode of literary representation.
Possession is examined in detail, while The Biographer’s Tale is used to provide a
backdrop to the discussion of Byatt’s viewpoints. Possession is a pastiche of styles,
incorporating some of Byatt’s favourite literary forms. Postmodernism allows this
experimentation but disregards qualities the author values highly, such as a
celebration of traditional literature and the emotional affectiveness of history.
Possession considers the positive and negative aspects of the literary movement. This
thesis examines Byatt’s negotiation with postmodernism and the contribution of her
critical attitude towards the success of Possession.

Music and spirit possession in Yorùbá worshipAmusan, Samuel January 2018 (has links)
This is a study of the relationship between music and spirit possession among the Yorùbá of the South-Western part of Nigeria. Through the ages, philosophers and scholars have been interested in the relationship between music and trance possession, especially the question of whether music triggers, influences or sustains trance or spirit possession, and if so, how. This thesis seeks to focus on the relationship between the music used in worship practices where possessions take place, and how the music might initiate and drive the possession states. Spirit possession is a phenomenon which springs from and is associated with the social and belief systems of different people. However, the Aládurà church (an Independent African Church - AIC) worshippers dissociate themselves from the possession practices that are experienced among the Yorùbá indigenous traditional worshippers, while the traditionalists claim that the spirit possession practised in the Aládurà churches originated and has its roots in the traditional practices. This suggests an inherent difference in the two belief systems even though the possession experiences among them are characterised by similar presentations. Following the theory that spirit possession practices are culturally determined, this research seeks to identify the specific cultural elements in the music used in Yorùbá worship traditions where possessions take place, not as a cause and effect, but how music affects the possession process. My study, therefore, sets out to investigate what could be a common factor between the two structurally and contextually different types of music used by the two sects of worshippers with the aim of identifying the common factors in the music, which seem to be the link between the two worship groups. Key words: Music, Spirit Possession, culture, worship.
