Research into efficient thermoelectric materials has gained traction recently be cause of their applications in converting waste heat into electricity. Chalcogenide and transition metals are among emerging classes of materials for potentials thermoelectric applications. In this work, we employ first-principle calculations and the Boltzmann transport equation along with self-consistent phonon theory to evaluate the thermoelectric performance of barium chalocgenide perovskites BaBX3 (B= Zr, Hf and X= S, Se) in the orthorhombic perovskite phase, as well as BaZreS3 in the needle-like phase. Vibrational properties were investigated through the phonon dispersion, mode Gruneisen parameters and lattice thermal conductivity to understand and measure the anharmonicity in the systems. The carrier transport properties including the Seebeck coefficient, electric conductivity and the electron contribution to thermal conductivity were evaluated. We report ultra low lattice thermal conductivity of κl = 1.23W/mK for BaHSe3 at T=300K by including high order phonon scattering events. A maximum power factor of 1.16 mW/mK2 was achieved at high n-doping concentration, resulting in a thermoelectric figure of merit zT = 0.2 for BaHSe3.

The work compares various approaches to periodization the profit and loss, describes the role of "revenue principle in separating the procedures of revenues and expenses in each accounting period and its role in Anglo-Saxon and continental accounting concept. For comparison, the above models are selected as a model of continental (European) approach the German Commercial Code HGB and the Anglo-Saxon approach as a model summary of the standards in the United States usually referred to as US GAAP standards and, ultimately, IFRS, which are attempt to reconcile the above models. The work describes the theoretical base of these models with regard to the fundamentals, principles and accounting categories such as revenues, expenses, gains, losses, assets, liabilities and equity.

Le constat est aujourd’hui unanime. Le principe de légalité criminelle est affaibli par les évolutions du droit. En effet, la loi pénale n’est plus l’unique source du droit pénal, sa qualité est en déclin et le juge joue désormais un rôle incontestable en droit pénal. Ces évolutions sont ancrées dans le droit pénal, dont elles sont des paramètres. Il est impossible de revenir en arrière afin de retrouver un droit pénal conforme au principe de légalité criminelle, tel que proclamé par les révolutionnaires de 1789. Il convient alors de le faire évoluer. Ainsi, ces paramètres ont en commun d’être à l’origine de la norme pénale. Contrairement à la loi pénale, la norme pénale intègre toutes les évolutions du droit pénal. Cette norme pénale est au cœur du droit pénal dont elle en est la source. Le principe de légalité criminelle n’est donc plus configuré autour de la loi pénale, mais autour de la norme pénale. Par conséquent, il convient de parler de principe de normativité criminelle. Cette reconfiguration est ainsi la solution face à un principe de légalité criminelle et une loi pénale en déclin. Elle permet de garantir la protection des droits et liberté individuelle tout en tenant compte des évolutions du droit. Il convient dès lors d’affirmer « qu’il n’y a pas d’infraction sans norme pénale ». / The consensus today is unanimous. The principle of criminal legality has been weakened by developments in law. Statute law is no longer the sole source of criminal law ; its influence is declining and judges will play an indisputable role in criminal law. These developments are rooted in criminal law, of which they are parameters. It is impossible to find a criminal law in history that conforms to the principle of criminal legality such as that proclaimed by the revolutionaries of 1789. It is therefore appropriate that it should evolve. Therefore, these parameters are together the origin of the criminal standard. Contrary to statute law, this standard integrates all developments in common law. This standard is at the core of the common law for which it is the source. The principle of criminal legality is therefore no longer configured with reference to statute law but the criminal standard. As a consequence, we should speak of the principle of the standardisation of criminal law. This reconfiguration is therefore the solution to a principle of criminal legality and a statute law in decline. It allows for the guaranteed protection of individual rights and liberties taking into account developments of law. From now on, it shoudl be affirmed « that there is no crime without the criminal standard ».

As variantes evolutivas da sociedade, especialmente a pós-moderna, com sua inerente complexidade e riscos, provocam a releitura das funções e estrutura da responsabilidade civil. À referida figura jurídica tanto pela observação ontológica (ser) como deontológica (dever-ser) cumpre tantos modelos quanto forem necessários à revitalização da vítima e avançando além do escopo reparatório à inerente preservação da pessoa humana considerada em suas dimensões individual e coletiva, em órbita de intangibilidade essencial (segurança), pois há danos de intensidade irreparável. O escopo da presente tese é justamente investigar a fragmentação da responsabilidade civil conforme as vicissitudes contemporâneas, imprimindo, para além do silogismo dedutivo-estruturalista, telos argumentativo-funcional, mediante as operações hermenêuticas possíveis proporcionadas pelos Princípios da Precaução e Prevenção, o que permite anunciar o modelo de Responsabilidade Civil Preventiva / The constant evolution of society, especially the postmodern, with its inherent complexity and risk, promotes a new reading of functions and structure of liability. To this legal figure, both by ontological as deontological observation, meets any models as necessary for the revitalization of the victim and - moving beyond the scope of reparation the inherent preservation of the essential intangibility (safety) of the human beings, considered in their individual and collective dimensions, because there are intense and irreparable damages. The scope of this thesis is precisely to investigate the civil liability fragmentation under the contemporary dynamic social changes, bringing, beyond the reasoning deductivestructuralist, meaning argumentative-functional, through the hermeneutical provided by the Precautionary Principle and Prevention, which allows to announce the Preventive Liability model .
