Electing the Leviathan

Thomas Hobbes is equally famous for his description of society without government being a perpetual war and his insistence that said war can be avoided if individuals come together and agree to create and obey a government. Unfortunately for Hobbes, the solution is not as simple as he portrays it to be. One problem is that Hobbes fails to explain how individuals will choose who will be a part of the newly created government. Without a compelling answer to this question, Hobbes cannot describe how individuals escape the perpetual violence and enter into a State. This thesis is an attempt to provide a sufficiently compelling answer to this problem. Though this problem has been addressed by other scholars including Jean Hampton and Peter Vanderschraaf, this thesis differs from previous inquiries by focusing on the role that the qualifications of candidates for sovereign play in an agreement being reached.

The Moral Foundations of the Social Contract in the Thought of Jean-Jacques Rousseau

Kelly / This dissertation is an attempt to elucidate Jean-Jacques Rousseau's answer to the question "why keep a promise?" with the aim of answering the more particular political question of why one should keep the social contract. I begin by explicating Rousseau's arguments against natural law in order to demonstrate why the theme of promises is so important for his political thought. Rousseau rejects the position that natural moral inequalities among people dictate who should rule and who should be ruled. Like other modern political thinkers, he maintains that political right derives from each citizen's signing of the social contract. But unlike some other modern thinkers, Rousseau denies that the self-interest of each individual is sufficient motivation for keeping that contract. Moreover, he argues that one who is merely self-interested and who makes promises "only for profit" will "set himself in contradiction with himself." I show the nature and causes of this contradiction in the soul. But although self-interested, deceitful promises cause one to come into contradiction with oneself, Rousseau does not believe that even awareness of this fact can sufficiently motivate people to give up the desire for what can be gained by deception. I therefore turn to the question of what can provide this motivation. I first examine Rousseau's understanding of moral freedom, virtue, and the conscience. I find that virtue is constituted by the commands of reason and the conscience, and that the conscience is formed out of well-ordered sentiments. Having these sentiments and the strength of soul necessary for virtue can make a person keep his promises and avoid coming into contradiction with himself. But most people lack this strength of soul, and therefore belief in a providential God is needed in order for them to be just. I then show how the faith of Rousseau's Savoyard Vicar is capable of providing sanctity to the social contract by allowing for the civic-minded appropriation of what Rousseau calls "the language of sign." / Thesis (PhD) — Boston College, 2014. / Submitted to: Boston College. Contractarianism With a Human Face

Contractarianism with a Human Face reinterprets the social contract, not as a model to generate a unique set of rules of justice, but as a dynamic process for making comparative institutional evaluations. An institutional reorientation allows contractarians to abandon the untenable assumption of a homogeneous model of agency (be it austere rational choice or Rawlsian reasonableness), replacing it with diverse agents living under institutions all can rationally endorse, and to which they have different reasons to comply. Contractarianism With a Human Face is a contractarian theory that differs from all other contractarian theories because it rejects the search for a unique answer to the question of what is justice. It does not flee from diversity, but instead finds new solutions to old problems through broadening the contractual model and the agents that make it up. This version of contractarianism has a human face in the sense that it starts from the diversity, disorder, and complexity of human life and seeks to find rules that we can all live under. Not by eliminating that diversity, but by embracing it. In so doing, however, it fundamentally changes the shape of contractarian theory. By rejecting the search for a unique "solution" to what rules of justice are justified, Contractarianism With a Human Face becomes a project of evaluating contingent and evolving institutions and constitutional rules. Rationality and justice are reconciled, at least partially, though human history.

Problems with Serial Murder Investigations

Serial murder investigations are normally hard for police to handle because of problems that appear internal and external to the police department. While the traditional techniques of investigating a crime (presence witness or witnesses, collecting evidence, and obtaining a confession from the suspect) are helpful in normal situations, their rare application to serial murder cases is only further complicated by other issues. This recognition of investigative issues is critical for not only apprehending these dangerous types of individuals but also for preventing more murders. Case studies of six serial killers have been examined to clarify the issues, using the traditional techniques of investigation as a reference. The data have been interpreted in terms of the factors present in helping to apprehend the offender as well as the problems that hindered the investigation. A final discussion of solutions and the identification of other problems that have not been previously addressed in other works are offered. It is imperative to take note of these issues and work to diminish and/or resolve them for more effectively pursuing serial killers. With acknowledgement of where law enforcement is deficient, a larger effort can be made to not only minimize but possibly even eliminate the errors within an investigation.
