交通肇事逃逸罪自1999年制定以來，從本罪保護法益的定位，直至個別構成要件之解釋，學說與實務的爭議從未停息。正因為保護法益解釋的分歧，連帶影響本罪構成要件的解釋。基此，本論文透過保護法益的分析，認為應以「個人生命身體法益」為解釋基礎，將交通肇事逃逸罪理解為交通領域的特殊遺棄罪，進而思考本罪構成要件應如何解釋。其後，本論文將進一步分析，交通肇事逃逸罪在不同法益脈絡的理解下，是否有違反刑事責任基本原則的疑慮。
